In order to protect the order of the socialist market economy and the legitimate rights and interests of the people, these Provisions are formulated in accordance with the Criminal Law of People's Republic of China (PRC), the Criminal Procedure Law of People's Republic of China (PRC), the Trademark Law of People's Republic of China (PRC), and the Supplementary Provisions of the NPC Standing Committee on Punishing the Crime of Counterfeiting Registered Trademarks.

1. Producers and sellers who violate the laws and regulations on trademark management and pass off others' registered trademarks and meet the filing standards stipulated in these Provisions shall be investigated for criminal responsibility according to law.

Two, counterfeit registered trademarks of others, the illegal income (that is, sales revenue, the same below) amount to the following standards, should be placed on file:

(1) Using a trademark identical to its registered trademark on the same commodity without the permission of the registered trademark owner, and the illegal income is more than 20,000 yuan;

(two) the illegal income of selling goods that are knowingly counterfeit registered trademarks is more than 20 thousand yuan;

(3) Forging or unauthorized manufacturing of another person's registered trademark logo or selling a forged or unauthorized registered trademark logo, and the amount of illegal income is more than 10,000 yuan.

Whoever colludes with criminals who counterfeit registered trademarks of others and provides them with convenient conditions such as manufacturing, selling, using, warehousing, transporting, mailing and concealing shall be investigated for criminal responsibility of criminals who counterfeit registered trademarks according to law.
