Article 4 The establishment of a patent agency must meet the following conditions:
(1) Have its own name, charter, and fixed office space;
( 2) Have necessary funds and working facilities;
(3) Be financially independent and be able to independently bear civil responsibilities;
(4) Have three or more people (firm = 3, company = 5 (or opening a branch office = 10) full-time personnel with patent agent qualifications and part-time personnel with patent agent qualifications in compliance with the ratio stipulated by the China Patent Office. A law firm that operates patent agency business must have full-time personnel as specified in Item 4 of the preceding paragraph.
Article 5 To apply to the patent administration authority for the establishment of a patent agency, the following documents shall be submitted:
(1) Application for establishment of a patent agency, and indicate the name of the patent agency Name, office location, name of person in charge;
(2) Articles of Association of the patent agency;
(3) Name of the patent agent and his qualification certificate;
(4) Written proof of the patent agency’s funds and facilities.
2. What specific information, procedures and related fees are required to open a trademark agency?
Article 4 To apply for the establishment of a trademark agency organization, the applicant shall apply for registration with the local industrial and commercial administration department at or above the county level and obtain an "Enterprise Legal Person Business License" or "Business License".
Can I merge with the patent agency into one company to handle it?
If the above conditions are met, they can be opened at the same time.
