What is Thailand trademark registration application-acceptance-examination-announcement-approval?

After the trademark application is accepted, the Thai Intellectual Property Office will conduct a formal review and substantive review of the application. A problem that applicants often encounter is product revision. After the official examination opinion is issued, the applicant only has 60 days (90 days before the revision of the Thai Trademark Law in 2016) to respond. Coupled with the delay in transmitting documents from the trademark agent, the applicant’s actual response time is less than 60 days, which is quite tight.

It is worth noting that if the applicant does not take any action or fails to respond to the trademark examination opinion, the trademark application will be rejected in its entirety. It is somewhat similar to failure to respond to China's patent examination opinions, which is regarded as withdrawn.

After passing the trademark examination, it will be announced in the Trademark Gazette of the Thai Intellectual Property Office for a period of 60 days (it was 90 days before the revision of the Thai Trademark Law in 2016). If there is no objection or the objection is not established, the trademark will be registered. Similar to the Chinese trademark registration process, the announcement time is shorter. However, the next revision of China’s trademark registration procedures is also planned to shorten the announcement time to 60 days.

The overall registration time for Thai trademarks, if things go smoothly, the trademark certificate will be issued about 18 months from the date of application
