Procedures for trans-provincial transfer of hazardous wastes
The procedures for trans-provincial transfer of hazardous wastes are as follows:

(1) Where solid waste is transferred out of the administrative area of a province, autonomous region or municipality directly under the Central Government for storage and disposal, an application shall be filed with the competent administrative department of environmental protection of the people's government of the province, autonomous region or municipality directly under the Central Government where the solid waste is moved out.

(2) The competent administrative department of environmental protection of the people's government of the province, autonomous region or municipality directly under the Central Government where the solid waste is removed shall obtain the consent of the competent administrative department of environmental protection of the people's government of the province, autonomous region or municipality directly under the Central Government where it is received before approving the removal of the solid waste from the administrative area of the province, autonomous region or municipality directly under the Central Government.

(3) Without approval, it may not be transferred.

Article 76 of the Law of People's Republic of China (PRC) on the Prevention and Control of Environmental Pollution by Solid Wastes, the people's governments of provinces, autonomous regions and municipalities directly under the Central Government shall organize relevant departments to formulate construction plans for facilities and places for centralized disposal of hazardous wastes, scientifically assess the demand for centralized disposal of hazardous wastes, rationally arrange facilities and places for centralized disposal of hazardous wastes, and ensure that hazardous wastes are properly disposed of within their respective administrative areas.

The construction planning of facilities and places for centralized disposal of hazardous wastes shall solicit the opinions of relevant industry associations, enterprises and institutions, experts and the public. Adjacent provinces, autonomous regions and municipalities directly under the Central Government may carry out regional cooperation and make overall plans for the construction of regional facilities and places for centralized disposal of hazardous wastes.

Article 77 The containers, packages, facilities and places for the collection, storage, transportation, utilization and disposal of hazardous waste shall be marked with hazardous waste identification marks in accordance with regulations.

Article 78 of the Law of People's Republic of China (PRC) on the Prevention and Control of Environmental Pollution by Solid Wastes, units that produce hazardous wastes shall formulate hazardous waste management plans in accordance with relevant state regulations; Establish a hazardous waste management ledger, truthfully record relevant information, and declare the type, output, flow direction, storage, disposal and other relevant information of hazardous waste to the local ecological and environmental authorities through the national hazardous waste information management system.

The hazardous waste management plan mentioned in the preceding paragraph shall include measures to reduce the output and harmfulness of hazardous waste, as well as measures to store, utilize and dispose of hazardous waste. The hazardous waste management plan shall be reported to the competent department of ecological environment where the hazardous waste generating unit is located for the record.

Units that produce hazardous waste shall implement the provisions of the pollution discharge permit management system when obtaining the pollution discharge permit.

Article 79 of the Law of People's Republic of China (PRC) on the Prevention and Control of Environmental Pollution by Solid Wastes, units that produce hazardous wastes shall store, utilize and dispose of hazardous wastes in accordance with relevant state regulations and environmental protection standards, and shall not dump or pile them up without authorization.
