What if the trademark you want to register is registered by others and the application period is less than three years and you can't apply for cancellation of the trademark? Of course, before that, we need to know the instructions for filling in the application for invalidation:

1. This application (the first page) is applicable to applications for invalidation of registered trademarks filed in accordance with the provisions of Article 44, paragraph 1, and Article 45, paragraph 1, of the Trademark Law.

2. An application for invalidation of a registered trademark filed in accordance with Articles 30 and 31 of the Trademark Law shall be filled in the "★" column.

3. The specific request for reexamination, facts, reasons and legal basis shall be submitted together with this application (home page) in accordance with the provisions of the Trademark Review and Adjudication Rules and the attached Application for the Invalidation of a Registered Trademark (text style). Where an application for invalidation of a registered trademark is made for some goods or services, it shall be clearly stated in the attached materials. This application (home page) and related materials shall be submitted in corresponding numbers according to the number of the other party.

4. If the disputed trademark or quoted trademark is registered internationally, the "G" shall be added before the registration number. 5. The disputed trademark category column can fill in multiple trademark categories at the same time.

6. If the cited trademarks belong to more than two categories, they shall be listed separately.

7. If the applicant is a foreigner or a foreign enterprise, it must fill in the accurate name and effective contact address, and the foreign address must indicate its China country. If the applicant is a natural person, the ID number should be filled in after the name.

8. Where an application for invalidation of a registered trademark is filed with the applicant or trademark holder, a representative shall be appointed; If there is no designated representative, the first person in the application sequence should be the representative. In this application (home page), only the name, mailing address, contact person and telephone number of the representative should be filled in the column of the applicant and his contact person, and other parties should indicate it in the attached materials. When the representative changes, the written authorization of the represented party must be obtained.

9. If a foreigner or foreign enterprise with a habitual residence or business office in China entrusts his representative in China to handle the invalidation of a registered trademark, his representative shall be regarded as the contact person of the applicant, and fill in the corresponding contents in the fields of the contact person, mailing address and telephone number of the applicant.

10. If the applicant needs to submit supplementary evidence after submitting the application for review, please tick "√" in the corresponding box and submit it within 3 months from the date of submitting the application for the first time.
