I was sentenced to half a year for credit card fraud. Can I successfully appeal?

Those who have been convicted of credit card fraud and have served their sentence can still appeal. Because the execution of judgments and rulings will not be stopped during the appeal period. Therefore, if the parties, their legal representatives, and close relatives are dissatisfied with the judgment or ruling that has taken effect or been completed, they may appeal to the People's Court or the People's Procuratorate.

Legal basis

Article 252 of the Criminal Procedure Law of the People's Republic of China

The parties and their legal representatives, recent Relatives may appeal to the People's Court or the People's Procuratorate against a legally effective judgment or ruling, but they cannot stop the execution of the judgment or ruling.

Article 256

If a case retried by the People's Court in accordance with the trial supervision procedures is tried by the original People's Court, a separate collegial panel shall be formed to conduct the trial. If it was originally a first-instance case, the trial shall be conducted in accordance with the first-instance procedures, and the judgment and ruling made may be appealed or protested; if it was originally a second-instance case, or a case brought to a superior people's court, the trial shall be conducted in accordance with the second-instance procedures. The trial is conducted according to the procedure, and the judgment and ruling made are the final judgments and rulings.

For retrial cases heard in court by the People's Court, the People's Procuratorate at the same level shall send personnel to attend the court.
