Will my credit card be frozen if I am sued?

Your credit card will be frozen if you are sued by the court. The credit card is part of the defendant's property and is legal property. The court has the right to go to the bank to inquire, freeze, and transfer bank deposits (including credit cards) due to judicial needs. If due to case handling or judicial needs, the court has the right to freeze the relevant bank accounts involved in the case; the general freezing period is six months, which can be extended once according to needs, and the general extension is three to six months; if it is suspected of violating the law, the account can be permanently frozen .

The following properties of the person subject to execution shall not be seized, detained, or frozen:

1. The living house, clothing, furniture, cooking utensils, etc. necessary for the life of the person subject to execution and his dependent family members. Tableware and other items necessary for family life;

2. Necessary living expenses for three months for the person subject to execution and his dependent family members; if there is a local minimum living security standard, the necessary living expenses shall be implemented in accordance with its standards;

3. Items necessary for compulsory education of the person subject to execution and his dependent family members;

4. Unpublished inventions or works;

5 , auxiliary tools necessary for the person subject to execution and his family members due to physical defects, as well as items used for medical treatment;

6. Sacrifice and worship supplies;

7. The person subject to execution is a natural person , its basic means of production;

8. Medals and other honorary items received by the person subject to execution;

9. Statutory deposit reserves deposited by financial institutions in the People's Bank of China and its business premises and armored vehicles in use;

10. The right to claim for payment based on the custody relationship, support relationship, and alimony relationship;

11. The financial nature of state agencies Funds and property indispensable for the performance of duties;

12. Houses, machines, equipment and other items necessary for the completion of public welfare undertakings that are being used by the public welfare legal person.

Sealing, detaining and freezing by the people's court A ruling shall be made on the movable, immovable and other property rights of the person subject to execution and shall be served on the person subject to execution and the person applying for execution.

If the measures of sealing, detaining, and freezing require the assistance of relevant units or individuals, the people's court shall prepare a notice of assistance in execution and serve it together with a copy of the ruling to the person assisting the execution. The sealing, detaining, and freezing rulings and execution assistance notices become legally effective when they are served.
