Can the wife be sued for the husband’s credit card debt?

If the credit card debt is within the duration of the marriage, the wife can be sued if the debt is the same debt. However, if one spouse can prove that the creditor and the debtor have clearly agreed that it is a personal debt, the wife cannot be sued. The Civil Code stipulates that upon divorce, debts originally incurred by the husband and wife while living together must be repaid jointly. If the property of the same person is insufficient to repay the debt, or if the property belongs to each of them, the two parties shall agree to repay the debt; if an agreement cannot be reached, the People's Court shall make a judgment. Article 1089 of the Civil Code stipulates that in the event of divorce, the husband and wife's debts shall be repaid jointly. If the property of the two parties is insufficient to repay or the property belongs to each other, the parties shall agree to repay the repayment; if the agreement fails, the People's Court shall make a judgment.
