1. The loan dispute is only a civil dispute, and it will not be suspected of criminal responsibility, let alone imprisonment;
If you are suspected of criminal responsibility, such as fraud, you will go to jail. It should be noted that criminal liability and civil liability are not the same thing. It is true that after bearing the liquidated damages, it is impossible to escape civil liability; There are mainly the following situations where you don't have to go to jail for debt:
(1) refused to execute the court decision. If the debtor refuses to pay back the money, the creditor will bring a lawsuit to the court. After the court ruled, the debtor still turned a deaf ear and refused to pay back the money. At this time, the creditor can bring a lawsuit to the court again and apply for enforcement. If the debtor refuses to implement it, he may be sentenced to fixed-term imprisonment of not more than three years, criminal detention or a fine according to the seriousness of the case; However, the premise is that during the execution period, the creditor needs to provide the court with strong evidence that the person subjected to execution has property and does not pay back the money;
(2) The credit card is maliciously overdrawn. If a credit card holder overdraws beyond the prescribed limit or term for the purpose of illegal possession, and fails to return it for more than 3 months after being urged twice by the issuing bank, it shall be deemed as "malicious overdraft". If the cardholder maliciously overdraws more than 6,543,800 yuan, it will be considered as a "large amount". Once the bank brings a lawsuit to the court, it will be sentenced to fixed-term imprisonment of not more than five years, criminal detention or fine;
(3) Borrowing money is not repaid. The fraud of "borrowing money but not paying it back" refers to the fraud that the actor uses fictional facts or conceals the truth for the purpose of illegal possession, and defrauds public and private property by borrowing money. For example, borrowers use the trust of others to defraud others of their money on the grounds of financial difficulties. This kind of fraud in the name of lending should be characterized as fraud.

The crime of refusing to execute the judgment or ruling is capable of executing the judgment or ruling of the people's court, and if the circumstances are serious, he shall be sentenced to fixed-term imprisonment of not more than three years, criminal detention or a fine; If the circumstances are especially serious, he shall be sentenced to fixed-term imprisonment of not less than three years but not more than seven years and shall also be fined.
If a unit commits the crime mentioned in the preceding paragraph, it shall be fined, and the directly responsible person in charge and other directly responsible personnel shall be punished in accordance with the provisions of the preceding paragraph.
Article 196
Under any of the following circumstances, it constitutes the crime of credit card fraud, and if the amount is relatively large, it shall be sentenced to fixed-term imprisonment of not more than five years or criminal detention, and shall also be fined not less than 20,000 yuan but not more than 200,000 yuan; If the amount is huge or there are other serious circumstances, he shall be sentenced to fixed-term imprisonment of not less than five years but not more than ten years, and shall also be fined not less than 50,000 yuan but not more than 500,000 yuan; If the amount is especially huge or there are other especially serious circumstances, he shall be sentenced to fixed-term imprisonment of not less than 10 years or life imprisonment, and shall also be fined not less than 50,000 yuan but not more than 500,000 yuan or confiscated property:
(a) using a forged credit card, or using a credit card fraudulently obtained with a false identity certificate;
(2) Using an invalid credit card;
(3) Fraudulent use of another person's credit card;
(4) malicious overdraft.
The term "malicious overdraft" as mentioned in the preceding paragraph refers to the behavior that the cardholder overdraws beyond the prescribed limit or time limit for the purpose of illegal possession, and refuses to return it after being urged by the issuing bank.
Whoever steals a credit card and uses it shall be convicted and punished in accordance with the provisions of Article 264 of this Law.
