What are the new features of credit card disputes?

1. The amount of credit card arrears increases

The credit card dispute cases accepted by Xicheng Court in 2008 and before generally involved a small amount of litigation, ranging from RMB 2,000 to RMB 5,000. cases accounted for 95%.

However, in the first two months of this year, the vast majority of credit card dispute cases handled by this court amounted to more than 10,000 yuan.

2. The debtor took the initiative to appear in court to respond

Most of the credit card dispute cases accepted by the court in the past could not find the cardholder, so the court could only announce and serve the relevant legal procedures. It can even be clearly seen that cardholders have serious subjective and malicious overdrafts.

Nowadays, most of the debtors are white-collar workers and corporate executives. They have relatively strong legal awareness. However, they are temporarily unable to repay their debts due to the impact of the financial crisis, but they can actively cooperate with the court to appear in court to respond.

3. Banks are considerate of difficulties and willing to mediate

During the survey, judges found that the proportion of mediation in credit card dispute cases continues to increase. In the cases accepted in the past, the bank insisted on requiring the debtor to repay all losses including principal, penalty interest, late fees, litigation fees, etc., and the difficulty of case mediation was also relatively high.

Now, it seems that banks can also understand and appreciate the "difficulties" of debtors, and have strengthened communication with cardholders. As long as the cardholders promise in writing to repay the principal and part of the interest as soon as possible, most banks can Make concessions and reach a mediation agreement with the cardholder.

4. Banks apply for property preservation

In order to recover losses, banks’ awareness of risk prevention and control has also been continuously strengthened. Last year, among the credit card dispute cases accepted by the Xicheng Court, there were only two cases in which banks filed preservation measures to ensure that compensation was paid.

However, at the beginning of 2009, some banks have already filed applications for property preservation when suing, and actively provide the court with property clues of debtors to minimize operating losses.

5. New types of cases appear

Under the new economic situation, new types of cases involving credit cards also appear.
