A credit card is a payment voucher. With a credit card, you can get property or consumer services. Stealing credit cards also indirectly occupies other people's property. Although it takes subsequent actions to really possess it, such as the behavior of the perpetrator fraudulently using the cardholder's signature, this process is actually a continuation of the theft crime and a means to achieve the purpose of the theft crime. Therefore, article 196 of the criminal law is regarded as theft.
Legal basis: Article 264 of the Criminal Law of People's Republic of China (PRC), whoever steals public or private property in a relatively large amount, or repeatedly steals, burglary, armed theft or pickpocketing, shall be sentenced to fixed-term imprisonment of not more than three years, criminal detention or public surveillance, and shall also or only be fined; If the amount is huge or there are other serious circumstances, he shall be sentenced to fixed-term imprisonment of not less than three years but not more than ten years and shall also be fined; If the amount is especially huge or there are other especially serious circumstances, he shall be sentenced to fixed-term imprisonment of not less than 10 years or life imprisonment, and shall also be fined or confiscated.
Article 265 of the Criminal Law of People's Republic of China (PRC) shall be convicted and punished in accordance with the provisions of Article 264 of this Law for the purpose of stealing other people's communication lines, copying other people's telecommunication code numbers or using telecommunication equipment and facilities that are knowingly stolen or copied.
