According to the provisions of China's Marriage Law, the pre-marital debts shared by both husband and wife should be counted as personal debts and cannot be treated as joint debts of husband and wife. During the existence of the relationship between husband and wife, one of the husband and wife bears the debt in its own name, and if it is agreed with the debtor, the other party will not bear the responsibility for repayment.
However, if the debts assumed by one spouse during the marriage relationship are not clearly personal debts, they should be regarded as joint debts of husband and wife. Both husband and wife are jointly and severally liable for the debt. At the same time, if the debt assumed by one of the husband and wife before marriage is used for the husband and wife to live together after marriage, it will also be treated as a joint debt of husband and wife.
