Whoever owes RMB 100,000 on a credit card and cannot repay it is considered a huge amount and shall be sentenced to fixed-term imprisonment of not less than five years but not more than ten years, and a fine of not less than RMB 50,000 but not more than RMB 500,000.
After the credit card is paid off, as long as the bank confirms that the user has paid off all credit card debts, the user can apply to cancel the credit card at that time. After the credit card balance has been paid off, the bank will accept the user's cancellation application, and then the user needs to wait for 45 days. Be careful not to incur any fees during these 45 days. Then the user's cancellation will be successful on the 46th day.
After the credit card is overdue, the bank will collect money from the cardholder. After the cardholder pays off the bill, if the cardholder does not actively mention canceling the card or closing the account, the bank will default to the cardholder continuing to use the card. The validity period of the card is generally about 3 years. After 3 years, the bank will default to the cardholder to continue using the card, and then make a new card for the cardholder. In other words, after the credit card is paid off overdue, the bank will not take the initiative to cancel the account, and the cardholder needs to take the initiative to apply for account cancellation.
If a cardholder wants to cancel their card or account, they need to first call the bank’s credit card hotline and then apply for card cancellation and account cancellation. Cardholders can also choose to apply offline and bring their ID cards to the counter to apply for credit card cancellation. Then the relevant staff will verify the borrower's personal information and other contents.
After being sued for not paying off a credit card, the cardholder needs to be held legally responsible. He must pay off all the outstanding balances on the credit card and can go through the account cancellation procedures. A credit card has a thirty-day interest-free period. During this period, the cardholder pays off the credit card debt on time and the bank will not charge interest. The credit card also has a certain useful life. One month before the credit card expires, the bank will notify the holder. The cardholder applies for a new credit card.
Legal basis
Article 196 of the "Criminal Law of the People's Republic of China",
Carry out credit card fraud under any of the following circumstances If the amount is huge or there are other serious circumstances, the sentence is to be not less than five years but not more than 10 years of fixed-term imprisonment or criminal detention, and a fine of not less than 20,000 yuan but not more than 200,000 yuan; If the amount is particularly huge or there are other particularly serious circumstances, the sentence shall be not less than 10 years in prison or life imprisonment, and a fine of not less than 50,000 yuan but not more than 500,000 yuan, or property confiscation: p>
(1) Using a forged credit card, or using a credit card fraudulently obtained with false identification;
(2) Using an expired credit card;
( 3) Fraudulent use of other people’s credit cards;
(4) Malicious overdraft. The term "malicious overdraft" as mentioned in the preceding paragraph refers to the cardholder's behavior of overdrafting beyond the prescribed limit or within the prescribed period for the purpose of illegal possession and failing to return the card after being called upon by the card-issuing bank. Anyone who steals a credit card and uses it shall be convicted and punished in accordance with the provisions of Article 264 of this Law.
