If the CCB credit card is not bound to the CCB card for automatic repayment, the bank cannot directly deduct the money for repayment. However, if the cardholder maliciously fails to repay the credit card arrears within the time limit, according to Article 34 of CCB's credit card charter, if the cardholder fails to repay the loan according to the contract, or commits illegal acts, or commits malicious acts such as fraud, and there are other risks, the bank has the right to choose one or more of the following measures: collect the arrears from him by letter, SMS, email, telephone, door-to-door and announcement; Stop using the card; Stop all cardholders from using Dragon Card; Require its guarantor to assume the guarantee responsibility; Dispose of its deposit or pledge; Deduct directly from any account opened by the cardholder in any branch of the bank, and have the right to ask the judicial organ to investigate the legal responsibility of the cardholder or take other corresponding recourse measures when necessary; Take other risk control measures. It is clear that "the cardholder will be directly deducted from any account opened in any branch of the bank".
Article 196 of the Criminal Law commits credit card fraud under any of the following circumstances. If the amount is relatively large, it shall be sentenced to fixed-term imprisonment of not more than five years or criminal detention, and shall also be fined not less than 20,000 yuan but not more than 200,000 yuan; If the amount is huge or there are other serious circumstances, he shall be sentenced to fixed-term imprisonment of not less than five years and fined not less than 50,000 yuan but not more than 500,000 yuan; If the amount is especially huge or there are other especially serious circumstances, he shall be sentenced to fixed-term imprisonment or life imprisonment, and shall also be fined not less than 50,000 yuan but not more than 500,000 yuan or confiscated property:
(1) Using forged credit cards;
(2) Using an invalid credit card;
3 fraudulent use of other people's credit cards;
4 malicious overdraft.
⑤ Whoever steals a credit card and uses it shall be convicted and punished in accordance with the provisions of Article 264 of this Law (as theft).
