The Criminal Law has this provision on credit card crimes: if an overdraft exceeds the prescribed limit or time limit, and the card issuer still fails to return it after two calls for more than 3 months, it is classified as Malicious overdraft. Malicious overdraft of more than RMB 10,000 and less than RMB 100,000 shall be deemed as a relatively large amount and shall be punished with imprisonment of not more than five years or criminal detention; if the amount is from RMB 100,000 to RMB 1 million, the amount shall be huge and shall be sentenced to imprisonment of not less than 5 years but not more than 10 years.
