Legal subjectivity:
1. For the purpose of illegal possession, the cardholder exceeds the prescribed limit or overdrafts within the prescribed period, and the card-issuing bank still fails to pay after two calls for more than 3 months. If it is returned, it can be deemed as "malicious overdraft" stipulated in Article 196 of the Criminal Law. Malicious overdraft of 10,000 to 100,000 yuan shall be punished with fixed-term imprisonment of not more than 5 years or criminal detention, and a fine of not less than 20,000 yuan but not more than 200,000 yuan; malicious overdraft of 100,000 to 1 million yuan shall be sentenced to fixed-term imprisonment of not less than 5 years but not more than 10 years. A fine of not less than RMB 50,000 but not more than RMB 500,000 shall be imposed. 2. Credit cards have a certain deferred repayment period, and repayments during this period are not considered overdue. But this period is different for each bank. (1) ICBC has no time limit and must repay before 24:00 on the repayment date. Once overdue, the card will be temporarily frozen. After the overdue period, the card can be unfrozen only after the full amount is exchanged, and the card limit will be reduced accordingly. (2) Guangfa Bank only provides three-day service once a year, and you must call and apply manually. 3. Use the minimum repayment amount of your credit card, and repaying the minimum repayment does not count as overdue. After the credit card bill comes out, there will be a minimum repayment amount. The so-called minimum repayment means that if the cardholder is unable to repay the full amount, the bank will deem the cardholder to have no breach of contract and will not affect the credit report. , but a certain amount of interest must be paid. This interest is calculated based on the daily interest rate of 5/10,000 of the total amount owed. It is still very high. It is best not to make the minimum repayment as a last resort. 4. Temporary quotas and cash withdrawals must be repaid in full and on time. Temporary quotas and cash withdrawals cannot be made in installments or with minimum repayments. If any, they must be repaid in full to avoid insufficient repayments caused by such negligence. Legal objectivity:
