Measures of Shenzhen Municipality on Urban Renewal
Chapter I General Provisions Article 1 In order to standardize the urban renewal activities of this Municipality, further improve the urban functions, optimize the industrial structure, improve the living environment, promote the economical and intensive utilization of land, energy and resources, and promote the sustainable development of economy and society, these Measures are formulated in accordance with the provisions of relevant laws and regulations and combined with the actual situation of this Municipality. Article 2 These Measures shall apply to urban renewal activities within the administrative area of this Municipality.

The term "urban renewal" as mentioned in these Measures refers to the activities of comprehensive improvement, functional change or demolition and reconstruction of the built-up areas of a specific city (including old industrial areas, old commercial areas, old residential areas, villages in cities and old residential areas, etc.). ) According to the procedures stipulated in the urban planning and these measures:

(1) Urban infrastructure and public service facilities need to be improved;

(two) the environment is bad or there are major security risks;

(three) the existing land use, the use function of buildings or the utilization of resources and energy obviously do not meet the requirements of social and economic development, which affects the implementation of urban planning;

(four) other circumstances in which urban renewal should be carried out according to law or with the approval of the municipal government. Article 3 Urban renewal shall follow the principles of government guidance, market operation, overall planning, economy and intensification, protection of rights and interests, and public participation to ensure and promote scientific development. Article 4 Urban renewal shall conform to the overall plan for national economic and social development and obey the overall plan for urban and land use. Urban renewal shall implement the system of urban renewal unit planning and annual plan management.

Urban renewal unit planning is the basic basis for managing urban renewal activities.

The annual plan of urban renewal shall be incorporated into the annual implementation plan of the recent construction plan and the annual plan of land use. Fifth urban renewal can be implemented by the municipal, district government, land use right holders or other qualified units in accordance with relevant laws and regulations and these measures. Article 6 The municipal and district governments shall guarantee the funds for organizing the implementation of urban renewal and give appropriate financial support to urban renewal projects.

Urban renewal involves the construction of infrastructure and public service facilities, and the corresponding project funds shall be arranged from the land transfer fee. Urban renewal involves government investment projects, which shall be implemented in accordance with the relevant provisions on the management of government investment projects. Article 7 The municipal competent department of planning and land is responsible for organizing and coordinating the city's urban renewal work, formulating land management policies related to urban renewal according to law, coordinating the planning and plan management of urban renewal, formulating technical specifications related to urban renewal, organizing the preparation of urban renewal unit planning, and being responsible for the transfer, recovery and acquisition of land use rights in the process of urban renewal. Article 8 The district government (including the new district management organization, the same below) shall organize the urban renewal land consolidation within its jurisdiction, organize the implementation of comprehensive renovation and renovation projects within its jurisdiction and the demolition and renovation projects determined by the municipal government, and coordinate the implementation of functional change projects and other demolition and renovation projects.

The municipal development and reform department is responsible for formulating industrial guidance policies related to urban renewal, and making overall arrangements for the annual funds for urban renewal involving government investment. The municipal finance department is responsible for allocating funds for urban renewal projects as planned.

The relevant competent departments shall, within the scope of their respective duties, provide services and implement management for urban renewal activities according to law. Chapter II Planning and Planning of Urban Renewal Article 9 The special planning of urban renewal in the whole city shall be linked with the recent construction planning according to the overall urban planning, and the key areas of urban renewal in the whole city and their renewal direction, objectives, time sequence, overall scale and renewal strategy shall be defined. Article 10 A statutory plan shall make the following provisions on urban renewal within its planned scope:

(a) the scope of urban renewal units;

(two) the type and scale of infrastructure and public service facilities that should be configured within the scope of urban renewal units;

(3) Planning guidelines for urban renewal units. Article 11 For the urban built-up areas that need urban renewal under the circumstances specified in Article 2 of these Measures, under the premise of ensuring the relative integrity of infrastructure and public service facilities, in accordance with relevant technical specifications, and taking into account natural factors such as roads, rivers and property rights boundaries, a larger area shall be designated as urban renewal units, and urban renewal unit planning shall be formulated.

An urban renewal unit may include one or more urban renewal projects. Twelfth urban renewal unit planning should be formulated in accordance with the relevant technical specifications, and publicity and consultation according to law.

Urban renewal unit planning shall include the following contents:

(a) the function, industrial direction and layout of land for infrastructure and public service facilities in urban renewal units;

(two) the specific scope, objectives, methods and planning control indicators of the renewal project in the urban renewal unit;

(3) Urban design guidelines in urban renewal units;

(four) other contents that should be clearly defined in the planning of urban renewal units.

If the urban renewal unit planning involves industrial upgrading, it shall solicit the opinions of the relevant industrial authorities. Thirteenth urban renewal unit planning should be formulated according to the control requirements determined by the statutory planning, and implemented after being approved by the municipal planning and land department.

In areas without statutory planning, urban renewal unit planning shall be formulated on the basis of investigation and study on the present situation and in accordance with the requirements determined by zoning planning, and shall be implemented after being approved by the municipal government. The relevant contents of urban renewal unit planning should be included in the formulation of statutory plans.

Urban renewal unit planning to adjust the mandatory content of statutory plans shall be implemented after being approved by the municipal planning and land department and reported to the municipal government. The corresponding contents shall be incorporated into the statutory plan and published.
