Regulations of Henan Province on Reward and Security of Courageous Persons
Chapter I General Provisions Article 1 In order to cultivate and practice socialist core values, promote social integrity, encourage courageous acts and safeguard the legitimate rights and interests of courageous people, these Regulations are formulated in accordance with relevant laws and regulations and in light of the actual situation of this province. Article 2 These Regulations shall apply to the confirmation of courageous acts within the administrative area of this province and the rewards and guarantees for courageous people.

These Regulations shall apply to persons registered in this province who are deemed to be courageous outside the administrative area of this province, except for acts of reward and protection. Article 3 The term "being courageous" as mentioned in these Regulations refers to the legal act of standing up and stopping the illegal and criminal acts being carried out or saving lives and providing disaster relief for the protection of national interests, social interests or the personal and property safety of others, not because of legal duties, legal obligations or agreed obligations. Article 4 Rewarding and guaranteeing courageous people should adhere to the principles of openness, fairness and justice, and implement the principle of combining government leadership with social participation, combining material rewards with spiritual encouragement, and combining pensions and preferential treatment with social security. Fifth people's governments at or above the county level shall be responsible for the reward and guarantee of courageous people, and establish and improve the coordination mechanism of various departments. Daily affairs are handled by public security organs.

The relevant departments of the people's governments at or above the county level, such as public security, education, civil affairs, finance, human resources and social security, housing and urban and rural construction, health and family planning, and people's organizations such as trade unions, the Communist Youth League, women's federations, and disabled persons' federations, shall, according to their respective functions and duties, do a good job in rewarding and guaranteeing the courageous people.

Radio, television, newspapers and other media should promptly publicize and report the advanced deeds of being brave and create a good social atmosphere. Article 6 The people's governments at or above the county level shall incorporate the reward and guarantee for the courageous people and the working funds into the fiscal budget at the corresponding level, and give them full protection. Seventh provincial cities and counties (cities, districts) established in accordance with the law of the courageous foundation, should be in accordance with the laws, regulations and articles of association to do a good job in the reward and protection of courageous people.

Courageous funds raised and used by the Courageous Foundation shall be earmarked for special purposes, subject to the supervision of civil affairs, finance, auditing and other departments and donors according to law, and announce the income and expenditure to the public every year.

Units and individuals are encouraged to donate or subsidize the courageous foundation, courageous people and their spouses, parents and children. Chapter II Determination of Acts Article 8 In any of the following circumstances, it shall be determined as a courageous act:

(a) to stop illegal and criminal acts that endanger national security, public safety or disrupt public order;

(two) to stop the illegal and criminal acts that endanger the state and collective property or the personal and property safety of others;

(three) take the initiative to capture or assist the relevant state organs in the pursuit of criminal suspects and criminals, and make important contributions;

(four) outstanding performance in emergency rescue, emergency rescue and disaster relief activities;

(five) other should be recognized as courageous. Ninth people's governments at or above the county level shall set up a courageous evaluation committee, which shall be responsible for confirming the courageous behavior.

The evaluation committee consists of chairman, vice-chairman and members. The chairman is responsible for convening the meeting of the evaluation committee.

The members of the evaluation committee are public security, civil affairs, human resources and social security, finance, education, health and family planning departments, NPC deputies, CPPCC members, model workers, legal workers and other relevant personnel.

The evaluation committee office is located in the public security organ, and is responsible for the specific work of accepting, investigating, obtaining evidence and verifying the courageous. Tenth beneficiaries should take the initiative to recommend courageous people. The people's governments of townships, sub-district offices and village (neighborhood) committees where the notified courageous people work or act occur shall also take the initiative to recommend courageous people.

When handling public security cases and criminal cases, public security organs shall submit them to the review committee for confirmation.

The doer of courageous acts and his close relatives or other insiders may also declare the courageous persons. Article 11 Recommend, declare and confirm the courageous people, generally should be submitted to the evaluation committee within two years from the date of occurrence, and provide the following corresponding certification materials:

(a) the proof materials of the unit where the courageous acts occur or the public security organs, civil affairs departments, township people's governments, neighborhood offices, relevant people's organizations and village (neighborhood) committees where the acts occur;

(two) the proof materials of the beneficiaries and witnesses of the courageous act;

(3) statements and confession materials of criminals;

(four) other materials that can prove the implementation of courageous acts. Twelfth recommendations and declarations with clear facts and complete supporting materials shall be accepted, investigated and verified by the review committee.

For the recommendation and declaration with unclear facts and incomplete certification materials, the review committee shall, within five days from the date of receiving the recommendation and declaration materials, inform the recommender and the applicant of the certification materials that need to be supplemented at one time; When necessary, the review committee may organize and coordinate relevant departments to conduct investigation and verification, and collect supporting materials. The relevant units and individuals shall actively cooperate and truthfully provide relevant certification materials.

The review committee shall, within 30 days from the date of receiving the recommendation, declaration or self-investigation and verification, put forward opinions on whether to confirm; If the situation is complicated, it can be extended to 60 days; If it is necessary to take the processing and appraisal conclusions of relevant departments as the basis for confirmation, the time required shall not be included in the confirmation period.
