chapter I general provisions article 1 in order to standardize the relationship between urban basic medical insurance, improve the urban basic medical insurance system, safeguard the legitimate rights and interests of insured persons, and promote the healthy development of urban basic medical insurance, these regulations are formulated in accordance with the social insurance law of the people's Republic of China and relevant state laws and regulations, combined with the actual situation of the autonomous region. Article 2 These Regulations shall apply to urban basic medical insurance within the administrative area of the autonomous region. Article 3 The urban basic medical insurance mentioned in these Regulations includes the basic medical insurance for employees and the basic medical insurance for urban residents. Article 4 The basic medical insurance for cities and towns adheres to the principle of full coverage, basic insurance, multi-level and sustainability, and follows the principle that the right to enjoy treatment corresponds to the obligation to pay fees, and the level of protection corresponds to the level of economic and social development. Fifth urban basic medical insurance on the basis of overall planning at the municipal level, and gradually realize the overall planning at the autonomous region level. Article 6 The people's governments at or above the county level shall incorporate the urban basic medical insurance into the national economic and social development plan, raise medical insurance funds through multiple channels, and assume corresponding government subsidy responsibilities. Seventh people's governments at or above the county level shall establish and improve the serious illness insurance system, improve the level of protection for serious and serious diseases, and realize the convergence of urban basic medical insurance, serious illness insurance and medical assistance. Article 8 The administrative department of medical insurance of the people's governments at or above the county level shall be responsible for the management of urban basic medical insurance within their respective administrative areas, and the medical insurance agencies shall specifically undertake urban basic medical insurance affairs. Grass-roots labor security stations assist in the promotion of urban basic medical insurance policies, handle insurance registration, consultation and other services. The personnel expenses of medical insurance agencies and the basic operating expenses and management expenses incurred in handling medical insurance shall be guaranteed by the finance at the same level in accordance with state regulations. Article 9 The financial department is responsible for the supervision of urban basic medical insurance revenue and expenditure and the formulation of financial accounting system, the management of financial accounts of urban basic medical insurance fund, and the examination and approval of the budget and final accounts of medical insurance fund. The local tax department is responsible for the collection and management of urban basic medical insurance premiums, and is responsible for providing the collection and payment of urban basic medical insurance premiums to the administrative department of medical insurance and the financial department. Audit institutions shall, in accordance with the relevant provisions of the state, audit and supervise the management and operation of the urban basic medical insurance fund. Development and reform, health, food and drug, civil affairs, public security, education and other relevant administrative departments shall, in accordance with their respective responsibilities, coordinate the management of basic medical insurance. Chapter II Registration of Medical Insurance Article 1 State organs, social organizations, enterprises and institutions, private non-enterprise units and their employees, individual industrial and commercial households and their employees shall participate in the basic medical insurance for employees. Individual industrial and commercial households without employees, part-time employees who have not participated in the basic medical insurance for employees in the employer and other flexible employees (hereinafter referred to as flexible employees) can participate in the basic medical insurance for employees. Eleventh urban full-time school students, preschool children, non-employed urban residents can participate in the basic medical insurance for urban residents. Article 12 the rights of the insured:
(1) enjoy the basic medical insurance benefits in cities and towns according to regulations;
(2) Inquire and check the payment and enjoy the treatment;
(3) Participate in the supervision of basic medical insurance;
(4) other rights stipulated by laws and regulations. Article 13 Obligations of the insured:
(1) Participating in urban basic medical insurance according to law;
(2) Pay the basic medical insurance premium in full and on time;
(3) Abide by the rules and regulations of urban basic medical insurance;
(4) When seeking medical treatment and enjoying the basic medical insurance benefits in cities and towns, they shall truthfully provide their relevant materials and information;
(5) other obligations stipulated by laws and regulations. Article 14 The employing unit shall, within 3 days from the date of employment, apply for the registration of basic medical insurance for its employees and declare and pay the medical insurance premiums for employees. Fifteenth flexible employees with valid identity documents and related information to the local medical insurance agencies to apply for basic medical insurance registration procedures. Sixteenth residents who meet the conditions of participating in the basic medical insurance for urban residents shall go through the registration formalities at the grassroots labor security station or the service window of the medical insurance agency with valid identity documents and relevant materials. Students in school are organized by their schools to participate in the basic medical insurance for urban residents in local medical insurance agencies. Chap III collection of medical insurance funds article 17 that collection and use of urban basic medical insurance fund shall be based on the principles of fixed income and expenditure, balance of income and expenditure and slight balance.
the financing standard of the urban basic medical insurance fund should be adapted to the local economic and social development level, medical consumption level and the basic medical needs of the insured.
the urban basic medical insurance fund consists of medical insurance premium income, financial subsidies, interest, transfer income and other income. Eighteenth employees' basic medical insurance premiums shall be paid by the employer and the employees.
the employer shall pay the employee's basic medical insurance premium at a rate of not less than 6% of the total wages of its employees in the previous year, and the employees shall pay at a rate of not less than 2% of their own wages. The specific payment ratio shall be determined and adjusted by the people's government of the overall planning area according to the local actual situation and reported to the medical insurance administrative department of the autonomous region for the record.
if the average wage of employees in the last year of the employing unit is lower than 8% of the average wage of employees in the last year of the overall planning area, 8% of the average wage of employees in the post shall be taken as the payment base; If it is higher than 3% of the average wage of on-the-job workers in the overall planning area last year, 3% of the average wage of on-the-job workers will be the base of payment.
