In November 2018, the Ministry of Civil Affairs announced the "Interim Measures for the Management of Value Preservation and Appreciation Investment Activities of Charitable Organizations", which clarified that charitable organizations are not allowed to directly buy and sell stocks.
Before 2016, China’s legislation did not define charity and charitable organizations. Article 3 of the “Public Welfare Donation Law” and Article 60 of the “Trust Law” only defined “public welfare”.
Judging from its content, the content included in public welfare is consistent with charity.
It can be seen from the provisions of the law that the scope of charity in our country is relatively wide, has the characteristics of openness, and is in line with the trend of widening the scope of charity.

Chapter 2: Charitable Organizations.
Article 8 The term "charitable organization" as used in this Law refers to a non-profit organization established in accordance with the law, in compliance with the provisions of this Law, and with the purpose of carrying out charitable activities for the society.
Charitable organizations can take the form of foundations, social groups, social service agencies and other organizational forms.
Article 9 Charitable organizations shall meet the following conditions.
(1) To carry out charitable activities as its purpose.
(2) Not for profit.
(3) Have its own name and address.
(4) It has articles of association.
(5) Have necessary property.
(6) Have an organizational structure and person in charge that meet the requirements.
(7) Other conditions stipulated by laws and administrative regulations.
Article 10 To establish a charitable organization, an application must be made to the civil affairs department of the people's government at or above the county level for registration, and the civil affairs department shall make a decision within thirty days from the date of acceptance of the application.
If the conditions stipulated in this Law are met, registration shall be allowed and the public announcement shall be made; if the conditions stipulated in this Law are not met, registration shall be denied and the reasons shall be explained in writing.
Non-profit organizations such as foundations, social groups, and social service agencies that have been established before the promulgation of this law may apply to the civil affairs department where they are registered to be recognized as charitable organizations. The civil affairs department shall make a decision within 20 days from the date of acceptance of the application.
If it meets the conditions of a charitable organization, it will be recognized and announced to the public; if it does not meet the conditions of a charitable organization, it will not be recognized and the reasons will be explained in writing.
If there are special circumstances where it is necessary to extend the registration or recognition period, it may be appropriately extended upon approval by the civil affairs department of the State Council, but the extension period shall not exceed sixty days.
