Article 1 In order to strengthen the management of Dalian harbor seal national nature reserve, protect harbor seals and their living environment, and maintain ecological balance, these measures are formulated in accordance with the Regulations of People's Republic of China (PRC) National Nature Reserve and other relevant laws and regulations, combined with the actual situation of this Municipality. Article 2 The Dalian Spotted Seal National Nature Reserve as mentioned in these Measures (hereinafter referred to as Spotted Seal Nature Reserve) refers to the marine aquatic wildlife nature reserve established with the approval of the State Council for the protection of spotted seal resources and their living environment.

Spotted seal reserve is located in Liaodong Bay of Bohai Sea in the west of this city, which is divided into three functional areas: core area, buffer area and experimental area. The area and scope of the harbor seal reserve and each functional area shall be implemented in accordance with the relevant provisions of the state. Article 3 These Measures shall apply to the management of the spotted seal reserve. Article 4 The municipal competent department of natural resources is the competent department of the harbor seal reserve, and its subordinate harbor seal reserve management agencies are responsible for the specific management of the harbor seal reserve.

The relevant departments of the municipal government, the district (city) government where the harbor seal reserve is located and the agencies with administrative functions of the municipal government shall be responsible for the relevant management of the harbor seal reserve according to their respective duties. Article 5 The management of spotted seal reserves shall adhere to the principles of combining comprehensive management with departmental management, combining daily management with important period management, and combining static management with dynamic management, and properly handle the relationship with local economic construction and residents' production and life. Article 6 All units and individuals have the obligation to protect the spotted seals and the ecological environment, and have the right to report and accuse acts that endanger the spotted seals and destroy the ecological environment. Article 7 The competent department of the harbor seal reserve shall organize the preparation of the construction plan of the harbor seal reserve and organize its implementation. Where all kinds of special plans prepared by relevant departments involve the harbor seal reserve, the opinions of the competent department of the harbor seal reserve shall be sought to ensure that all kinds of special plans conform to the construction plan of the harbor seal reserve.

The management institution of the harbor seal reserve shall prepare the management and protection plan of the harbor seal reserve according to the construction plan of the harbor seal reserve and organize its implementation. Eighth harbor seal reserve management agencies shall formulate emergency plans for environmental pollution incidents in harbor seal reserves.

Units that may have major marine environmental pollution incidents around the harbor seal reserve shall formulate emergency plans for environmental pollution incidents and equip them with corresponding personnel, materials and equipment according to the emergency plans. The emergency plan shall be reported to the competent department of environmental protection, the competent department of the spotted seal reserve and the management institution of the spotted seal reserve for the record. Article 9 Persons entering the harbor seal reserve shall abide by the various management systems of the harbor seal reserve and accept the management of the harbor seal reserve management organization.

Engaged in scientific research, teaching, sightseeing, tourism and other activities in the spotted seal reserve, should go through the relevant procedures according to law. Article 10 No construction projects shall be allowed in the core area and buffer area of the spotted seal reserve. Production facilities that pollute the environment and destroy resources shall not be built in the experimental area of the spotted seal reserve; The pollutant discharge of other construction projects shall not exceed the national and local pollutant discharge standards. The facilities built in the experimental area of the spotted seal reserve, whose pollutant discharge exceeds the national and local discharge standards, shall be treated within a time limit; If damage is caused, remedial measures must be taken. Eleventh engaged in the development and construction may have an impact on the harbor seal reserve, it shall consult with the management agencies of the harbor seal reserve, and then go through the relevant formalities according to law. Article 12 If the development and construction have an impact on the ecological environment of the spotted seal reserve, the ecological compensation shall be made according to the principle of who develops, who protects, who destroys, who restores, who benefits, who compensates, who pollutes and who pays. Thirteenth it is forbidden to hunt and hurt spotted seals; It is forbidden to catch spotted seals, except in cases that can be caught according to laws and regulations.

Those who catch spotted seals by mistake in fishing operations should be released immediately and unconditionally. Article 14 If a unit or individual finds that a spotted seal is injured, stranded or caught by mistake in a port, a branch of a river, a net, etc., it shall report to the competent department of the spotted seal reserve or the management institution of the spotted seal reserve, and may take emergency rescue measures; Do not have the conditions to take emergency rescue measures, you can ask nearby units with emergency rescue conditions to take emergency rescue measures. After the death of the spotted seal, it shall be properly handled by the competent department of the spotted seal reserve. Article 15 The migration period of spotted seals is from 1 February1day to April 30th every year.

If the construction project may affect the spotted seal and its living environment, it should avoid the migration period of the spotted seal. Article 16 Anyone who suffers economic losses due to the protection of spotted seals may claim compensation from the competent department of the spotted seal reserve. If the investigation is true and compensation should be given, compensation shall be given according to law. Seventeenth acts in violation of these measures shall be handled by the relevant departments or institutions according to law. Article 18 If the competent department of the harbor seal reserve, the management institution of the harbor seal reserve or other relevant departments violate these measures and commit any of the following acts, the people's government at the same level, the relevant departments of the people's government at a higher level or the supervisory organ shall order them to make corrections according to their functions and powers; The responsible person in charge and other directly responsible personnel shall be given administrative sanctions according to law:

(a) the construction planning or management planning of the spotted seal reserve has not been compiled;

(two) the preparation of various special plans involving the spotted seal reserve does not conform to the construction plan of the spotted seal reserve;

(3) Failing to formulate an emergency plan for environmental pollution accidents in the spotted seal reserve;

(4) approving the construction of production facilities in the core area and buffer area of the harbor seal reserve, or approving the construction of production facilities that pollute the environment and destroy resources in the experimental area of the harbor seal reserve.
