As a victim, the social assistance fund for traffic accidents does not need to be repaid, and the person responsible for traffic accidents needs to be repaid. Rescue expenses exceed the liability limit, and did not participate in compulsory motor vehicle third-party liability insurance or escape after the accident, the road traffic accident social assistance fund shall advance part or all of the rescue expenses, and the road traffic accident social assistance fund management institution has the right to recover from the person responsible for the traffic accident.

What is the traffic accident handling process?

1, accept the report. After receiving a report from a party or other person, the public security traffic management department shall file a case according to its jurisdiction.

2. On-site treatment. After accepting the case, the public security traffic management department immediately sent personnel to the scene to rescue the injured and property, explore the scene and collect evidence.

3. Responsibility identification. The traffic administrative department of public security shall, on the basis of finding out the facts of traffic accidents, determine the responsibility of the parties for traffic accidents according to the causal relationship between the illegal acts of the parties and the traffic accidents and the role of the parties.

4. Reward and punish. The traffic administrative department of public security shall, in accordance with the relevant provisions, punish those responsible for the accident with warnings, fines, suspension, revocation of driving licenses or detention.

5. Mediation of damages. Compensation for personal injuries and economic losses caused by traffic accidents shall be divided into corresponding compensation proportions in accordance with relevant regulations and compensation standards, and the public security traffic management department shall convene both parties to mediate. The two sides agreed to reach an agreement that the accident mediator would make and issue a conciliation statement for damages.

6. Bring a lawsuit to the court. If both parties fail to mediate within the statutory time limit, the public security traffic management department will terminate the mediation and issue a mediation conclusion, and both parties will bring a civil lawsuit to the court.

Legal basis: Article 24 of the Regulations on Compulsory Liability Insurance for Motor Vehicle Traffic Accidents.

The State establishes a social relief fund for road traffic accidents (hereinafter referred to as the relief fund). Under any of the following circumstances, the funeral expenses and part or all of the rescue expenses of the victims of road traffic accidents shall be paid in advance by the relief fund, and the relief fund management institution shall have the right to recover from the persons responsible for road traffic accidents:

(a) the cost of rescue exceeds the liability limit of compulsory insurance for motor vehicle traffic accidents;

(two) the motor vehicle did not participate in the compulsory insurance of motor vehicle traffic accident liability;

(3) A motor vehicle escapes after an accident.
