In order to help a specific object, fund-raising activities and mutual donation activities for specific groups such as units or communities shall be implemented in accordance with relevant laws and regulations, and these regulations shall not apply.
The public welfare undertakings mentioned in these Regulations refer to the following non-profit projects:
(a) groups and individuals with special difficulties such as disaster relief, poverty alleviation and disability assistance;
(2) Education, science, culture, health and sports;
(3) Environmental protection and public facilities construction;
(4) Other social undertakings and welfare undertakings. Article 3 Fund-raising shall abide by laws and regulations, and shall not violate social morality, harm the public interests and the legitimate rights and interests of others, or engage in profit-making activities in the name of fund-raising.
Fundraising should be honest, open and transparent.
Donations should respect the wishes of donors, and apportionment or disguised apportionment is prohibited.
Donations should respect the personal dignity of others, and personal privacy, business secrets and other information of donors and beneficiaries should not be disclosed. Article 4 Encourage and support fund-raisers to carry out fund-raising activities according to law. Encourage and support natural persons, legal persons or other organizations to donate property to fund-raisers. Fifth civil affairs departments of people's governments at or above the county level shall be responsible for the management of fund-raising within their respective administrative areas.
Finance, auditing, taxation and other relevant departments shall do a good job in fund-raising management within their respective responsibilities. Chapter II Fundraisers Article 6 Red Cross Societies, charities and public offering foundations established according to law may carry out fund-raising activities in accordance with laws and regulations. Article 7 Public welfare social organizations and public welfare non-profit institutions other than those specified in Article 6 of these Regulations need to raise property from the public in order to carry out public welfare activities. Meet the following conditions, with the permission of the civil affairs department of the local people's government, you can carry out fundraising activities within the scope of permission:
(a) personnel and places to carry out fund-raising and public welfare activities;
(2) The financial accounting system and information disclosure system are legal, standardized and effective;
(3) Other conditions stipulated by laws and regulations. Article 8 Apply to the civil affairs department of the local people's government for permission to raise funds, including an application for fund-raising activities, a fund-raising plan and relevant supporting materials.
The civil affairs department shall, within fifteen working days from the date of receiving the application materials, make a decision on whether or not to grant permission. If the fund-raising activity is approved, the applicant shall be issued with a fund-raising activity permit, which shall specify the name of the fund-raiser, the fund-raising project, the time limit and area of the fund-raising activity, etc. If the license is not granted, it shall inform the applicant in writing and explain the reasons. Article 9 The fundraiser as stipulated in Article 6 of these Regulations shall publish the following information on the website of the fundraiser and the website of the civil affairs department of the local people's government every year, and update it in time when the content changes:
(1) Name and address;
(2) Basic information about the legal representative, board of directors, board of supervisors and offices;
(3) Articles of association and business scope;
(four) the management and use of donated property;
(5) Annual work report, financial accounting report and audit report;
(six) other information that should be disclosed in accordance with laws and regulations.
The fund-raiser specified in Article 7 of these Regulations shall publish the relevant information such as the institution registration certificate, the fund-raising activity permit, the fund-raising activity plan, the annual work report, the financial accounting report and the audit report of the last three years on the website of the civil affairs department of the local people's government. Chapter III Fund-raising Behavior Article 10 Fund-raisers may raise funds in the following ways:
(a) through radio, television, newspapers, websites and other media;
(2) placing donation boxes in public places;
(three) two or more staff members hold valid certificates of the fundraiser to persuade the fundraiser;
(four) send a letter of advice or send advice information;
(5) Charity performances, charity competitions, charity bazaars and charity auctions;
(6) other appropriate methods. Eleventh to encourage radio, television, newspapers, websites and other organizations to assist the Red Cross, charities, public foundations or other fund-raisers to carry out charity performances, charity competitions, charity bazaars, charity auctions and other fund-raising activities. Article 12 Before a fund-raiser carries out fund-raising activities, he shall formulate a fund-raising plan, report it to the civil affairs department of the local people's government for the record, and publish it on the website of the fund-raiser and the website of the civil affairs department of the local people's government. The fundraising plan shall include the following contents:
(a) the purpose, time and area of fundraising;
(2) Ways of raising funds;
(3) the use plan of the donated property;
(4) Work cost plan;
(5) others.
If the fundraising plan does not contain the contents specified in the preceding paragraph or there are other circumstances that do not conform to the provisions of laws and regulations, the civil affairs department shall promptly prompt and urge the fundraiser to correct.
The fundraiser shall make donations according to the published fundraising plan.
