September 13 to September 15, and September 13 (Saturday) is a public holiday.

September 14 (Mid-Autumn Festival on August 15th of the lunar calendar) is a legal holiday.

The public holiday on September 14 (Sunday) was changed to September 15 (Monday).

According to the relevant regulations of the State Council General Office, the Mid-Autumn Festival will be closed for three days from September 13 to September 15. Yesterday, the relevant departments in Shanghai issued a reminder that when the employer arranges overtime on September 14, it should pay overtime wages at least 300% of the daily or hourly wages of the workers.

During the public holidays on September 13 and September 15, if the employer arranges overtime for the workers, it can arrange compensatory time off for the workers without paying overtime. If no compensatory time off is given, overtime pay not less than 200% of the daily or hourly wages of the workers shall be paid.

At the same time, the labor department reminds workers that the base for calculating overtime wages is not necessarily the total wages of workers. When determining the calculation base of overtime pay, if there is an agreement on salary in the labor contract, it shall be determined according to the salary standard of the employee's post not lower than that stipulated in the labor contract. If there is no agreement in the labor contract, it can be made clear in the collective contract through collective consultation between the employer and the employee representatives. If there is no agreement between the employer and the employee, it shall be determined according to 70% of the employee's monthly salary for normal attendance.
