Measures of Shanghai Municipality on Basic Endowment Insurance for Urban and Rural Residents
Chapter I General Provisions
Article 1 (Purpose and Basis)
In order to comprehensively promote the construction of the basic old-age insurance system covering urban and rural residents in the city, these measures are formulated according to the Social Insurance Law of People's Republic of China (PRC) and the Opinions of the State Council on Establishing a Unified Basic Old-age Insurance System for Urban and Rural Residents, combined with the actual situation of this Municipality.
Article 2 (Guiding Principles)
In accordance with the principles of full coverage, basic security, flexibility and sustainability, and focusing on enhancing fairness, adapting to mobility and ensuring sustainability, the basic old-age insurance system for urban and rural residents in this Municipality (hereinafter referred to as "the old-age insurance for urban and rural residents") is established. Linking with the basic old-age insurance system for employees, matching with other social security policies such as social assistance and social welfare, giving full play to the positive role of traditional security methods such as family pension, and better ensuring the basic life of insured urban and rural residents.
Article 3 (Scope of Application)
Urban and rural residents who have registered in this city, have reached the age of 16 (excluding students at school) and are not included in the basic old-age insurance system for employees can participate in the old-age insurance for urban and rural residents.
Article 4 (Administrative Department)
Municipal Human Resources and Social Security Bureau is the administrative department in charge of endowment insurance for urban and rural residents.
Municipal Finance Bureau, Civil Affairs Bureau, Municipal Disabled Persons' Federation, Municipal Agriculture Commission and other departments shall, according to their respective functions and duties, coordinate the implementation of these measures.
The district and county governments shall do a good job in the organization, management and implementation of endowment insurance for urban and rural residents within their respective jurisdictions.
Chapter II Fund Raising
Article 5 (Composition of Funds)
The endowment insurance fund for urban and rural residents consists of individual contributions, collective subsidies and government subsidies.
Article 6 (Personal Payment)
Those who participate in the endowment insurance for urban and rural residents shall pay the endowment insurance premium in accordance with the regulations. Article 7 (Collective Subsidies)
Conditional village collective economic organizations shall give subsidies to the insured, and the subsidy standard shall be determined by the members' meeting convened by the villagers' committee or the village collective economic organization. Encourage other social and economic organizations, charitable organizations and individuals to provide financial support for the insured. Article 8 (Government Subsidies)
The government pays the basic pension in full to the insured who meet the conditions for receiving the old-age insurance for urban and rural residents.
District and county governments subsidize the payment of household registration insured persons in their respective jurisdictions. 500 yuan, 700 yuan, 900 yuan, 1 100 yuan, 1300 yuan, 1500 yuan, 1700 yuan, 1900 yuan, 2 100 yuan and 2300 yuan per year.
District and county governments pay part or all of the old-age insurance premiums for the severely disabled and other groups with payment difficulties within their respective jurisdictions. The payment standard for individuals with severe disabilities is determined according to 1 100 yuan per year, of which 5% of the payment standard is paid by individuals, and the employment security fund for the disabled is remitted to 600 yuan, and the rest is remitted by the district and county finance. The severely disabled and unemployed who receive living allowance for severely disabled people do not pay, and the employment security fund for the disabled is remitted to 600 yuan, and the county finance is remitted to 500 yuan. Specific measures shall be formulated separately by the Municipal Federation of Disabled Persons and the Municipal Finance Bureau and other relevant departments.
Article 9 (Adjustment of Standards)
The adjustment of individual payment standards and payment subsidy standards shall be put forward by the Municipal Human Resources and Social Security Bureau in conjunction with the Municipal Finance Bureau according to the income growth of urban and rural residents in this Municipality, and shall be promulgated and implemented after being approved by the municipal government.
Article 10 (Establishment of Personal Account)
This Municipality establishes a personal account for endowment insurance with lifelong records for each insured person. Individual contributions, subsidies from district and county governments to the insured, and collective subsidies and contributions from other social and economic organizations, charitable organizations and individuals to the insured are all credited to personal accounts. The amount stored in individual accounts shall bear interest according to the provisions of the state.
Chapter III Pension Insurance Benefits
Article 11 (Conditions for Endowment Insurance Benefits)
Those who have participated in the old-age insurance for urban and rural residents, who have reached the age of 60, paid a total of 15 years, and have not received the basic old-age security benefits stipulated by the state and this Municipality can receive the old-age insurance benefits for urban and rural residents on a monthly basis.
When the new rural social endowment insurance (hereinafter referred to as the "new rural endowment insurance") system or the urban social endowment insurance (hereinafter referred to as the "urban residence insurance") system is implemented in this Municipality, those who have reached the age of 60 and have not received the basic old-age security benefits stipulated by the state and this Municipality do not need to pay fees, and can receive the basic old-age pension for urban and rural residents on a monthly basis from the date of implementation of these Measures; If the collection period is less than 15 years, the insufficient years will be paid back year by year, and it is also allowed to pay back. The cumulative payment period after payment shall not exceed 15 years; Those who have received the payment for more than 15 years shall be paid annually, and the accumulated payment shall not be less than 15 years.
Article 12 (Composition of treatment)
Endowment insurance for urban and rural residents consists of basic pension and personal account pension, which is paid for life.
Article 13 (Basic Pension)
The monthly standard of basic pension is 540 yuan (including the minimum standard of basic pension determined by the central government); If the payment period exceeds 15 years, the basic pension will be increased 1 year/0 yuan.
The basic pension is shared by the municipal finance (including the central financial subsidy funds) and the district and county finance according to the proportion of 30% and 70%. Among them, the district and county finance bears the corresponding basic pension for the recipients of the old-age insurance benefits for urban and rural residents registered in this area.
Article 14 (Adjustment of Treatment)
The city has established a normal adjustment mechanism for the basic pension of urban and rural residents' old-age insurance. The basic pension of urban and rural residents' old-age insurance shall be adjusted in a timely manner according to the national minimum standard of basic pension and the economic development and price changes of this Municipality.
Article 15 (Personal Account Pension)
The monthly payment standard of personal account pension is the total amount of personal account divided by 139. If the insured dies, the balance of funds in his personal account can be inherited according to law.
Article 16 (Funeral Grant)
If the recipient of the pension insurance for urban and rural residents dies, the pension will be stopped from the next month, and his family members can receive a funeral subsidy of 3,600 yuan.

The adjustment of funeral subsidy standards shall be put forward by the Municipal Human Resources and Social Security Bureau in conjunction with the Municipal Finance Bureau according to the economic development and price changes of this Municipality, and shall be promulgated and implemented after being approved by the municipal government.
Article 17 (Qualification Certification)
The endowment insurance agency for urban and rural residents shall check the recipients of endowment insurance benefits for urban and rural residents every year; Village (neighborhood) committees shall assist urban and rural residents' old-age insurance agencies to carry out their work, publicize the eligibility of the insured within the administrative village (community), and compare them with the records of the basic old-age security benefits stipulated by the state and this Municipality to ensure that they are not heavy, leaking or bad.
Chapter IV Inheritance and System Cohesion
Article 18 (Transfer and Continuation within the System)
Those who participate in the old-age insurance for urban and rural residents need to transfer the old-age insurance relationship between urban and rural residents across provinces and cities during the payment period, and can apply for the transfer of the old-age insurance relationship at the place where they move in, transfer all the storage amount in their personal accounts at one time, and continue to pay insurance premiums in accordance with the provisions of the place where they move in, and the payment period is calculated cumulatively.
Persons who have received pension insurance benefits for urban and rural residents according to regulations, regardless of whether the household registration is transferred or not, their pension insurance relationship is not transferred.
Article 19 (Connection of Related Systems)
The connection between the old-age insurance system for urban and rural residents and the basic old-age insurance system for employees shall be implemented in accordance with the relevant provisions of the state and this Municipality.
The measures for land-expropriated personnel, survivors of employees who died not because of work, and reducing the spouses of retired old employees who returned to their hometowns to participate in the old-age insurance for urban and rural residents shall be implemented in accordance with the relevant provisions of the state and this Municipality.
Article 20 (Connection between Old and New Systems)
After the establishment of the old-age insurance system for urban and rural residents, those who participated in the rural social old-age insurance under the new rural endowment insurance system, those who used to enjoy the old-age subsidies for elderly farmers and those who used to enjoy the old-age security benefits for urban elderly residents under the urban housing insurance system will be treated according to the principle of "locking in the crowd and making a smooth transition in treatment".

Chapter V Fund Management
Article 21 (Fund Management and Operation)
The new rural endowment insurance fund and urban residential insurance fund will be merged into urban and rural residents' endowment insurance fund, and municipal management will be implemented.
The endowment insurance fund for urban and rural residents shall be included in the financial special account of the municipal social security fund, and the fund shall be managed by two lines of revenue and expenditure, with separate bookkeeping and independent accounting. No department, unit or individual may misappropriate, falsely report or impersonate.
The funds undertaken by the municipal finance and the district and county finance are included in the financial budgets at all levels, and are allocated to the financial accounts of the municipal social security fund by the municipal finance and the district and county finance sub-projects.
The endowment insurance fund for urban and rural residents shall be invested and operated in accordance with the unified provisions of the state to maintain and increase the value.
Establish a financial accounting system for the endowment insurance fund for urban and rural residents. The specific measures shall be formulated separately by the Municipal Finance Bureau in conjunction with the Municipal Human Resources and Social Security Bureau.
Article 22 (Supervision of Funds)
The human resources and social security department shall, jointly with the relevant departments, earnestly perform the duties of fund supervision, establish and improve the internal control system and the fund audit supervision system, supervise and inspect the fund raising, transfer, distribution, storage and management, disclose information in accordance with the regulations, and accept social supervision.
The financial department and the audit department shall, according to their respective responsibilities, supervise the income and expenditure, management and investment operation of the fund. Actively explore effective ways for village (neighborhood) representatives to participate in social supervision, so that the fund is open and transparent and the system operates in the sun.
The relevant departments shall severely deal with such violations of discipline and law as false reporting, impersonation, misappropriation, corruption and waste in accordance with the relevant provisions of the state and this Municipality.
Chapter VI Handling Management Services and Informatization Construction
Article 23 (Institutions)
The endowment insurance for urban and rural residents in this city is managed by the municipal social insurance management center, and the district and county governments determine the specific contractors of the social insurance agencies in this district and county, and the street (township) community affairs acceptance center accepts specific cases.
Article 24 (Handling Management Services)
District and county governments should strengthen the capacity building of urban and rural residents' endowment insurance, scientifically integrate the existing public service resources and social insurance management resources, enrich and strengthen the grassroots handling power, and realize accurate management and convenient service; Pay attention to the use of modern management methods and government purchase services to reduce administrative costs and improve work efficiency; Provide necessary workplaces, facilities, equipment and funds for intermediaries.
Social insurance agencies should strengthen the professional training of urban and rural residents' endowment insurance staff and improve the level of public service. Establish various business management rules and regulations, carefully record the payment and treatment of urban and rural residents, establish insurance files, and properly keep them according to regulations.
Article 25 (Working Funds)
The endowment insurance fund for urban and rural residents shall be included in the fiscal budget at the same level, and shall not be spent from the endowment insurance fund for urban and rural residents.
Article 26 (Informatization Construction)
Establish a municipal centralized information management system for urban and rural residents' endowment insurance, incorporate it into the construction of social security information management system ("Golden Insurance Project"), share information resources with other citizens' information management systems, extend the information network to the grassroots level, and realize real-time networking of cities, districts, counties, towns (streets) and communities. Conditional counties can be extended to administrative villages to facilitate urban and rural residents to pay insurance premiums, receive benefits and inquire about insurance information.
Chapter VII Supplementary Provisions
Article 27 (Detailed Rules for Implementation)
Municipal Human Resources and Social Security Bureau, Municipal Finance Bureau and other departments in accordance with these measures, formulate detailed rules for implementation.
Article 28 (Implementation Period)
The Measures shall be implemented from May of 1 year and shall be valid until April 30th. If other relevant provisions of this Municipality are inconsistent with these Measures, these Measures shall prevail.
The Shanghai Municipal People's Government's Implementation Opinions on Implementing the Guiding Opinions of the State Council on the Pilot Project of New Rural Social Endowment Insurance (No.39 of Hu Fu Fa [2010]) and the Shanghai Municipal People's Government's Implementation Opinions on Implementing the Guiding Opinions of the State Council on the Pilot Project of Social Endowment Insurance for Urban Residents (No.88 of Hu Fu Fa [20165438]) shall be abolished at the same time.
