Article 1 In order to strengthen the construction of vegetable bases, ensure the sources of funds for the development of new vegetable fields and the basic transformation of old vegetable fields, and standardize the raising of funds for the development and construction of new vegetable fields, these measures are formulated in accordance with the Land Management Law of the People's Republic of China and other relevant laws and regulations. Article 2 The municipal administrative department of agriculture shall be responsible for the collection and management of the fund for the development and construction of new vegetable fields in this Municipality.

The fund for the development and construction of new vegetable fields in each district shall be uniformly collected by the municipal administrative department of agriculture.

The fund for the development and construction of new vegetable fields in county-level cities shall be collected by the administrative department of agriculture at the corresponding level. Third in the city within the scope of the expropriation of vegetable land, land units shall pay the new vegetable land development and construction fund.

The vegetable fields mentioned in these Measures include the following cultivated land:

(a) All cultivated land where vegetables are grown all the year round;

(two) all the vegetable fields in the basic farmland protection areas designated with the approval of the Municipal People's government;

(three) cultivated land that has been rotated with other crops for more than three consecutive years to grow vegetables.

Whether it belongs to vegetable fields or not shall be subject to the land category determined by the technical report on land survey and demarcation corresponding to the land use approval document. In case of dispute, it shall be decided by the land administrative department in conjunction with the agricultural administrative department. Article 4 The collection standard of new vegetable field development and construction fund is 6.5438+500,000 yuan/hectare. Article 5 To pay the new vegetable field development and construction fund, you should go through the payment formalities with the agricultural administrative department with the land area certification materials such as the Notice of Paying the New Vegetable Field Development and Construction Fund, the land requisition approval document and the corresponding technical report on land survey and demarcation.

The competent agricultural administrative department or the collecting bank shall, after collecting the new vegetable field development and construction fund in accordance with the provisions of Article 4 of these Measures, issue the Guangdong provincial government fund (fund) general bill or the Guangdong provincial non-tax revenue (electronic) bill to the payer.

The payer shall go through the formalities of land use with the payment voucher. Land administrative departments shall go through the formalities for land use according to law for land units that have paid the new vegetable field development and construction fund in full, and shall not go through the formalities for land use for land units that have not paid the new vegetable field development and construction fund in full. Article 6 The fund for the development and construction of new vegetable fields collected by the municipal administrative department of agriculture shall be unified into the fund budget management, and two lines of revenue and expenditure shall be implemented to ensure earmarking. Among them, 30% will be returned to local finance, and 70% will be used by the city as a whole according to regulations.

The new vegetable field development and construction fund collected by the administrative department of agriculture of county-level cities shall be uniformly included in the budget management of the fund at the corresponding level. 30% shall be turned over to the municipal finance within 10 days after the end of each quarter, and 70% shall be used by county-level cities according to regulations, and shall not be withheld or misappropriated. Seventh new vegetable development and construction funds should be used for the development and construction of vegetable fields. The municipal administrative department of agriculture shall, according to the actual amount collected in the previous year, organize the administrative departments of agriculture of all districts and county-level cities to declare projects.

The specific scope of use of the new vegetable field development and construction fund includes:

(a) the city and district, county-level city planning new vegetable leveling, irrigation and drainage, improve the quality of land and other basic projects and equipment purchase;

(two) the purchase of production facilities and equipment necessary for the transformation and potential tapping of old vegetable fields;

(three) vegetable base infrastructure construction and post-disaster recovery production construction;

(four) investigation and planning, technical training and scientific experiments necessary for the development of new vegetable fields;

(five) other purposes as prescribed by the state.

The municipal finance department is responsible for the supervision of the new vegetable field development and construction fund. Eighth new vegetable development and construction fund collection departments each year according to the work plan and tasks, submitted to the special collection business expenditure plan, after the audit of the financial sector into the departmental budget. Business funds should be earmarked. Article 9 If a new vegetable field development and construction fund collection and management unit and its staff members commit any of the following acts, the unit to which they belong or the competent department at a higher level shall give administrative sanctions to the main person in charge or the person directly responsible, and if the case constitutes a crime, the judicial organs shall investigate the criminal responsibility according to law:

(a) the units or individuals that fail to pay the new vegetable field development and construction fund according to the regulations;

(two) the illegal approval of exemption, reduction and deferment of new vegetable development and construction funds;

(three) interception, embezzlement and misappropriation of funds for the development and construction of new vegetable fields;

(four) other acts in violation of the provisions on the administration of fund collection. Article 10 These Measures shall be implemented as of September 1 day, 2065. 1On June 20, 998, the Measures for the Collection of Vegetable Field Construction Fees in Guangzhou promulgated by the Municipal People's Government shall be abolished at the same time.
