In order to further standardize the management of royalties and prices of exploration and mining rights, the supplementary notice on specific issues in the implementation of the Notice of the Ministry of Finance and the Ministry of Land and Resources on Printing and Distributing the Measures for the Management of Royalties and Prices of Exploration and Mining Rights (Cai Zong Zi [1999] No.74, hereinafter referred to as the Measures) is as follows:

1. The term "state contribution" as mentioned in these Measures refers to the funds allocated by the central and local governments for mineral resources exploration and development in the form of geological exploration fees, mineral resources compensation fees, mining rights use fees, price income and various funds.

Where the central finance, local finance, enterprises and institutions jointly contribute to the exploration and development of mineral resources, they shall enjoy the right to contribute in proportion to their respective contributions. The income from the price of exploration and mining rights formed by the central and local financial allocations shall be managed in accordance with the provisions of these Measures.

Two, for the transfer of exploration and mining rights currently shelved and formed by the state, the registration administration organs at all levels shall collect the price of exploration and mining rights from the prospecting and mining rights holders in accordance with the regulations. If it is really difficult to pay the price of exploration and mining rights, with the approval of the Ministry of Land and Resources and the Ministry of Finance, all or part of the price of exploration and mining rights that should be paid by state-owned enterprises and institutions can be converted into state capital or state funds; State-owned enterprises and institutions holding shares in joint ventures, joint-stock companies and joint-stock cooperative enterprises shall pay the price of exploration rights and mining rights, which can be converted into state shares with the approval of the Ministry of Land and Resources and the Ministry of Finance.

Three, in order to meet the needs of the four-level registration authority to collect mining rights royalties and prices, all localities should standardize the management of the city (prefecture) county registration authority to collect mining rights royalties and prices. Specific management measures shall be formulated by the provincial finance department in conjunction with the administrative department of Geology and mineral resources at the same level in accordance with the provisions of these measures, combined with local conditions, and reported to the Ministry of Finance and the Ministry of Land and Resources for the record.

Four, exploration rights and mining rights use fees charged directly by the registration authority, it is not appropriate to implement the method of entrusted collection. If it is really necessary to entrust the collection, it must be approved by the administrative department of Geology and mineral resources at the next higher level, and a power of attorney shall be issued. The use fee and price charged by the entrusted registration administration organ in accordance with the provisions shall be paid in full to the financial special account at the same level for unified management and use.

5. According to the Measures for the Administration of Registration of Mineral Resources Exploration Blocks (Order No.240 of the State Council) and the Measures for the Administration of Registration of Mineral Resources Exploitation (Order No.24/KLOC-0 of the State Council), the royalties and prices of exploration rights and mining rights belong to the national fiscal revenue and are included in the budget management. The financial departments at all levels and the registration administration organs charge the royalties and prices of exploration and mining rights, and do not need to apply for license fees, but they must do a good job in the collection and management of royalties and prices of exploration and mining rights in strict accordance with the provisions of the Measures.

Six, according to the requirements of the exploration right, mining right use fee and price are mainly collected by the central and provincial registration administration organs, the registration administration organ of the administrative department of Geology and mineral resources of the State Council collects the exploration right, mining right use fee and price special receipt, which is printed by the finance department of the State Council; The provincial finance department is responsible for printing the special receipt for the use fee and price of exploration and mining rights collected by the registration authority of the administrative department of geology and mineral resources below the provincial level.
