Legal analysis: selling a house needs to pay a maintenance fund. After the maintenance fund is used, if it is less than one third of the down payment, it needs to be replenished as soon as possible. The maintenance fund is used for the maintenance and repair of community public works, and no one may use it for other purposes. Moreover, the maintenance fund is less than about 30% of the first deposit, which needs to be paid by the maintenance fund management unit and the active cooperation of the community owners.
Legal basis: Article 28 of the Measures for the Administration of Residential Special Maintenance Funds. When the ownership of the house is transferred, the owner shall explain to the transferee the deposit and balance of the special maintenance funds for the house, and issue a valid certificate. The remaining residential special maintenance funds in the housing ledger are transferred with the ownership of the house.
