1. After an industrial accident, the industrial injury insurance fund and the employer shall pay compensation respectively according to different situations;

Expenses paid by the industrial injury insurance fund, such as medical expenses, are generally paid by the employer in advance and then reimbursed, and do not need to be paid to the employee himself; If the industrial injury level reaches 10 or above after the labor ability appraisal, the industrial injury insurance fund will pay a one-time disability allowance, which can be paid to the company account about one month after the industrial injury appraisal is completed and the industrial injury insurance fund is applied for. As for when the company will transfer to the account of employees with work-related injuries, it depends on the efficiency of the employer.

Legal basis: Article 40 of the Social Insurance Law of People's Republic of China (PRC).

Workers with work-related injuries who meet the conditions for receiving basic old-age pension will stop receiving disability allowance and enjoy basic old-age insurance benefits. If the basic old-age insurance benefits are lower than the disability allowance, the difference will be made up by the industrial injury insurance fund.

Article 41

If the employer fails to pay the work-related injury insurance premium according to law and an industrial accident occurs, the employer shall pay the work-related injury insurance benefits. If the employer does not pay, it shall pay in advance from the industrial injury insurance fund.

The industrial injury insurance benefits paid in advance from the industrial injury insurance fund shall be repaid by the employer. If the employer fails to repay, the social insurance agency may recover the compensation in accordance with the provisions of Article 63 of this Law.
