Measures for the administration of social assistance funds for road traffic accidents in Jiangsu Province
Article 1 In order to strengthen the management of social assistance funds for road traffic accidents and provide assistance to victims of road traffic accidents, these Measures are formulated in accordance with the Road Traffic Safety Law of the People's Republic of China, the Regulations on Compulsory Insurance for Motor Vehicle Traffic Accidents and other laws and regulations. Article 2 These Measures shall apply to the collection, use and management of social assistance funds for road traffic accidents within the administrative area of this province.

The measures referred to in road traffic accident social relief fund (hereinafter referred to as the relief fund) refers to the social special fund raised in accordance with the law for paying part or all of the rescue expenses, funeral expenses and providing relief to families with special difficulties caused by motor vehicle road traffic accidents. Article 3 The management of relief funds shall adhere to the principles of openness, fairness and convenience, and implement unified policies, centralized management, division of responsibilities among departments and operation of professional institutions throughout the province to ensure the healthy and efficient operation of relief funds. Article 4 The Provincial People's Government shall set up the Jiangsu Provincial Social Assistance Fund Management Coordination Group (hereinafter referred to as the Provincial Assistance Fund Coordination Group). The Provincial Relief Fund Coordination Group consists of an office (hereinafter referred to as the Office of the Provincial Relief Fund Coordination Group), which is responsible for the daily management of the relief fund. The office of the Provincial Relief Fund Coordination Group is located in the financial department of the provincial people's government.

The people's governments of cities and counties (cities) divided into districts shall set up a coordination group for social relief funds for road traffic accidents to assist in the advance and recovery of relief funds. Article 5 The sources of relief funds include:

(a) according to a certain proportion of motor vehicle traffic accident liability compulsory insurance (hereinafter referred to as compulsory insurance) insurance funds;

(two) the financial subsidies given by the provincial people's government;

(3) the fruits of the relief fund;

(four) the funds recovered from the traffic accident compensation obligor of the motor vehicle road according to law;

(5) social donations;

(6) Other funds.

The proportion of compulsory insurance premiums in this province shall be determined by the financial department of the provincial people's government in conjunction with the insurance supervision and management institutions in accordance with the relevant provisions of the state. An insurance company shall, in accordance with the determined extraction ratio, transfer the full amount of the extracted funds to the special account of the provincial relief fund in time. Article 6 Relief funds shall be accounted for separately and managed in special accounts, and used in strict accordance with the prescribed purposes.

The management expenses of the relief fund shall be approved and guaranteed by the provincial finance, and shall not be charged in the relief fund. Article 7 The relief fund shall establish an expert evaluation system for disputes over relief expenses, and employ experts in medicine, law, insurance and accident handling to form an expert database. If the victims of road traffic accidents are seriously injured, the rescue time is long, the amount of advance payment is large and the applicant disagrees with the audit results, an expert audit will be conducted. The specific measures shall be formulated by the Office of the Provincial Relief Fund Coordination Group. Eighth provincial relief fund coordination group office in accordance with the procedures and methods of government procurement services, from the relevant professional institutions to determine the best relief fund managers, and signed a management contract according to law.

When the relief fund manager changes or cancels the entrusted management contract, it shall conduct an audit according to law. Article 9 The relief fund manager shall be responsible for the daily operation and management of the relief fund according to the entrusted management contract, and perform the following management duties:

(1) Accepting and examining the earlier application in accordance with regulations, and making a decision on whether to go ahead;

(two) decided to go first, in accordance with the scope, objects and procedures;

(3) Recovering the advance payment and handling legal affairs such as litigation, mediation and arbitration related to recovering the advance payment;

(four) other matters entrusted by the provincial relief fund coordination group office.

The relief fund manager shall set up relief outlets in the cities and counties (cities) divided into districts, and announce the telephone number, address, relief outlets, materials required for applying for advance payment, advance payment list, recovery and other information to the public. Article 10 A relief fund manager shall keep the financial files and related materials of the relief fund according to law; Regularly clean up and audit the advance payment and the recovered advance payment, and the unrecoverable advance payment shall be written off after being approved by the Provincial Relief Fund Coordination Group Office in accordance with relevant regulations. Eleventh relief fund managers shall, within 90 days after the end of the year, submit the financial and accounting reports audited by accounting firms in the previous year to the Office of the Provincial Relief Fund Coordination Group. Article 12 Under any of the following circumstances, victims of motor vehicle road traffic accidents or their close relatives, medical institutions that provide assistance (hereinafter referred to as medical institutions) and funeral service institutions that provide funeral services (hereinafter referred to as funeral service institutions) may apply to the rescue network of the rescue fund manager in the place where the traffic accident occurred within 30 working days:

(a) the rescue expenses and funeral expenses exceed the compulsory insurance liability limit;

(two) the motor vehicle did not participate in compulsory insurance;

(3) A motor vehicle escapes after an accident. Thirteenth to apply for advance rescue expenses, the following application materials shall be submitted:

(1) The applicant's identity certificate, the victim's identity certificate or the statement that the victim's identity cannot be confirmed issued by the traffic administrative department of the public security organ;

(2) An application for advance payment;

(3) Relevant materials issued by the traffic administrative department of the public security organ;

(4) Relevant materials issued by medical institutions.

The relief fund generally pays the victim's relief expenses within 72 hours after receiving the relief. Under special circumstances, if the application for advance rescue expenses exceeds 72 hours, the application materials shall also include a written explanation made by the medical institution.
