1. What is unemployment insurance?
Unemployment insurance refers to a social insurance system that is enforced by the state through legislation and the government is responsible for establishing unemployment insurance funds. For those who have the ability and desire to work within the working age, lose their jobs for reasons other than their own, and cannot maintain the required wage income, the state and society provide them with basic living security and re-employment services for a certain period of time. Unemployment insurance has the functions of ensuring life, promoting employment and preventing unemployment.
2. Which units and individuals should participate in unemployment insurance?
Urban enterprises and institutions, private non-enterprise units, social organizations, laborers who have formed labor relations with them and full-time staff of social organizations within the jurisdiction of our province shall participate in unemployment insurance according to law. The term "urban enterprises" as mentioned in these Measures refers to state-owned enterprises, urban collective enterprises, joint-stock cooperative enterprises, joint ventures, limited liability companies, joint-stock companies and urban private enterprises; Enterprises invested by Hong Kong, Macao and Taiwan businessmen; Enterprises with foreign investment. The term "institution" as mentioned in these Measures refers to a social service organization organized by a state organ or other organization using state-owned assets to engage in education, science and technology, culture, health and other activities for the purpose of public welfare. The term "private non-enterprise units" as mentioned in these Measures refers to social organizations engaged in non-profit social service activities organized by enterprises, institutions, social organizations, other social forces and individual citizens using non-state-owned assets. The term "social organization" as mentioned in these Measures refers to a non-profit social organization which is composed of China citizens voluntarily and raised funds by themselves, and carries out activities in accordance with its articles of association to achieve the consent of its members.
3. How to pay unemployment insurance premium?
According to laws, regulations and document policies, payment is divided into three stages:
(1) 1, before March 2065438, according to the provisions of Article 9 of the Regulations on Unemployment Insurance in Heilongjiang Province, the unit must pay unemployment insurance premium at 2% of its total salary; Individuals must pay unemployment insurance premium according to 1% of their salary. Units and individuals shall pay unemployment insurance premiums in full in monetary form. Unemployment insurance premiums paid by individuals shall be withheld and remitted from their own wages by their units.
(II) As of March 2065 1, according to the Notice of Heilongjiang Provincial Department of Human Resources and Social Security and Heilongjiang Provincial Department of Finance on Relevant Issues Concerning Adjustment of Unemployment Insurance Rate (Heishefa [2065438+05] No.49), the unit payment rate for participating in unemployment insurance was adjusted from 2% of my total salary to 1.5. The unemployment insurance premium paid by the individual shall be withheld and remitted from the individual's salary by the employer.
(III) As of May 1 day, 1965, according to the Notice on Issues Related to Decreasing Unemployment Insurance Rate by Stages issued by the Department of Human Resources and Social Security of Heilongjiang Province and the Department of Finance of Heilongjiang Province (Heishefa [2065438+06] No.58), the contribution rate of unemployment insurance units is 1.5% of the total wages of their own units. The time limit for reducing the rate is temporarily implemented for two years. The unemployment insurance premium paid by the individual shall be withheld and remitted from the individual's salary by the employer.
4. What conditions must the unemployed meet to receive unemployment insurance?
Unemployed persons who meet the following conditions shall receive unemployment insurance money from the unemployment insurance fund:
(1) Before unemployment, the employer and I have paid unemployment insurance premiums for one year;
(2) Discontinue employment without my own will;
(3) Those who have registered for unemployment and have job requirements.
5. How to calculate the payment period of unemployment insurance?
Article 46 of the Social Insurance Law stipulates that: before the unemployed lose their jobs, if the accumulated contributions of the unemployed and the employer are over one year but less than five years, the longest period of receiving unemployment insurance benefits is twelve months; If the accumulated payment is over five years but less than ten years, the maximum period for receiving unemployment insurance benefits is eighteen months; If the accumulated payment is more than ten years, the maximum period for receiving unemployment insurance benefits is twenty-four months.
Article 26 of the Regulations on Unemployment Insurance in Heilongjiang Province stipulates that before unemployment, the unit where the unemployed person works and himself shall receive unemployment insurance benefits for two months every full year according to the regulations, but the longest period shall not exceed 24 months.
According to the principle that the subordinate law must be consistent with the superior law, and according to the provisions of Article 46 of the Social Insurance Law, the calculation method of unemployment insurance benefits time limit in our province is as follows:
The time limit for the unemployed to receive unemployment insurance benefits is calculated according to the accumulated payment time of the employer and himself before unemployment: if the accumulated payment is over 1 year and less than 5 years, they will receive unemployment insurance benefits for 3 months every 1 year; If the accumulated payment is less than 10 years, the unemployment insurance premium of 14 months will be received in the fifth year, and the unemployment insurance premium will be increased by 1 month every year. If the accumulated payment exceeds 10 year, the unemployment insurance premium for 20 months will be paid according to 10 year, starting from 1 1 year. The unemployment insurance premium will be increased by 2 months every full year 1 year, but the longest period shall not exceed 24 months.
If you are unemployed again after re-employment, the payment time will be recalculated, and the period of receiving unemployment insurance benefits will be combined with the period of receiving unemployment insurance benefits that should have been received but not received in the previous unemployment, and the longest period will not exceed 24 months.
6. What are the procedures for applying for unemployment insurance?
(1) The employing unit shall issue a certificate of termination or dissolution of labor relations for the unemployed in time, informing them to enjoy the rights of unemployment insurance benefits in accordance with the regulations, and report the list of unemployed persons to the unemployment insurance agency where the unemployed are registered within 15 days from the date of termination or dissolution of labor relations. If the employer fails to handle the unemployment insurance formalities for the unemployed in time according to the regulations, which affects the enjoyment of unemployment insurance benefits by the unemployed, the employer shall compensate the unemployed for the losses thus suffered.
(two) the unemployed shall, within 60 days from the date of termination or dissolution of labor relations, go through the unemployment registration at the designated employment service agency with the certificate of termination or dissolution of labor relations issued by the unit. Unemployed persons shall, with unemployment registration certificate and personal identification certificate, go to the unemployment insurance agency in time to go through the formalities of receiving unemployment insurance benefits.
(3) When applying for unemployment insurance benefits, the unemployed shall fill in the Application Form for Unemployment Insurance Benefits, the Job Registration Form and the Training Application Form, and submit the following supporting materials:
(1) my identity certificate (2 copies of ID card and household registration book)
(2) the certificate of termination or dissolution of labor relations issued by the employer;
③ Two copies of employment unemployment registration certificate;
(4) Three recent one-inch bareheaded photos;
⑤ Provide 2 copies of my agricultural bank card;
⑥ Provide accurate telephone contact information;
(four) the agency shall, within 7 working days from the date of accepting the application of unemployed persons in unemployment insurance benefits, examine and confirm the qualifications of the applicant and inform the applicant of the results and related matters. Those who pass the examination will be paid unemployment insurance money from the date of unemployment registration.
7. What other projects are included in unemployment insurance benefits?
(a) the unemployed during the period of receiving unemployment insurance benefits, to participate in the basic medical insurance for employees, enjoy the basic medical insurance benefits. The basic medical insurance premiums payable by the unemployed are paid from the unemployment insurance fund, and individuals do not pay the basic medical insurance premiums.
(2) If an unemployed person dies while receiving unemployment insurance benefits, he shall be given a one-time funeral grant and pension to his survivors with reference to local regulations on the death of on-the-job employees. The required funds are paid from the unemployment insurance fund. If an individual dies and meets the conditions for receiving basic old-age insurance, industrial injury insurance and unemployment insurance funeral subsidies, his survivors can only choose to receive one of them.
(3) In maternity grants, unemployed women who gave birth during the period of receiving unemployment insurance benefits and met the national family planning regulations were given unemployment insurance benefits for three months at a time with the approval of local social insurance agencies.
8. Under what circumstances do unemployed people stop enjoying unemployment insurance benefits?
Unemployed persons who have one of the following circumstances during the period of receiving unemployment insurance benefits will stop receiving unemployment insurance benefits and enjoy other unemployment insurance benefits:
(1) Failing to go through the collection formalities or explain the job search every month without justifiable reasons;
(2) Re-employment;
(3) Those who should be conquered for military service;
(4) emigration;
(five) enjoy the basic old-age insurance benefits;
(six) twice refused to accept the appropriate job or training provided by the employment agencies or institutions designated by the local people's government without justifiable reasons.
(7) If the agency finds that the unemployed are sentenced to fixed-term imprisonment or forced to be isolated for drug rehabilitation during the period of receiving unemployment insurance benefits, it will suspend receiving unemployment insurance benefits and retain the time limit for receiving unemployment insurance benefits.
Nine, how to transfer the unemployment insurance relationship?
(1) Where employees and unemployed persons are employed across regions within the administrative region of this province and participate in unemployment insurance, the unemployment insurance relationship shall be transferred from the original insured place to the new insured place. The original insured place is hereinafter referred to as the transfer place, and the new insured place is hereinafter referred to as the transfer place. The transfer procedure is as follows:
1. Employees and unemployed persons apply to the transfer agency for the transfer of unemployment insurance relationship with their identity certificates (household registration book, original and photocopy of ID card), fill in the Approval Form for the Transfer of Unemployment Insurance Relationship of Insured Employees, and receive the Certificate for the Transfer of Unemployment Insurance Relationship.
Workers and unemployed persons shall provide the following information when applying to the transfer agency for transfer unemployment insurance:
(1) my identity certificate (household registration book, original and photocopy of ID card)
(2) An application for the transfer of unemployment insurance relationship;
(3) Proof of transfer of unemployment insurance relationship.
2. The transfer-in agency shall examine and accept the application, and if there is no objection, it shall issue a notice of acceptance of the transfer of unemployment insurance relationship to the transfer-out agency within 7 working days from the date of accepting the application.
3. The transfer-out agency shall handle the transfer of the applicant's unemployment insurance relationship with the transfer-in agency within 7 working days from the date of receiving the Notice of Acceptance of the Transfer of Unemployment Insurance Relationship, and send the Information Form of the Transfer of Unemployment Insurance Relationship.
4. The transfer agency shall continue the unemployment insurance relationship within 7 working days from the date of receiving the Information Form on the Transfer of Unemployment Insurance Relationship, and notify the applicant.
(two) to receive unemployment benefits across the overall regional transfer, unemployment insurance benefits will be transferred, the procedure is as follows:
1. The unemployed apply to the transfer agency with the following information, and fill in the Approval Form for the Transfer of Unemployed Persons in Different Places in unemployment insurance benefits.
(1) my identity certificate (household registration book, original and photocopy of ID card);
(2) Employment unemployment registration certificate;
(3) Proof of termination or dissolution of labor relations;
(4) Application for the transfer of unemployment insurance relationship.
The transfer agency shall review the application for transfer in unemployment insurance benefits, verify the unemployment insurance benefits standard and time limit for eligible personnel to enjoy in the local area, and issue a certificate of transfer of unemployment insurance relationship for the unemployed.
2. Unemployed persons shall apply for unemployment insurance to the agency where the transfer is located with the following information:
(1) my identity certificate (household registration book, original and photocopy of ID card);
(2) Employment unemployment registration certificate;
(3) bareheaded photos of the unemployed;
(four) enjoy the unemployment insurance benefits application;
(5) Used to receive bank account information of unemployment insurance benefits;
(6) Proof of termination or rescission of labor relations.
(7) The original labor contract and original files.
When examining and accepting the application, the agency where the transfer place is located shall issue a notice of acceptance of the transfer of unemployment insurance relationship to the agency where the transfer place is located within 7 working days from the date of accepting the application.
3. The transfer-out institution shall timely verify the amount of unemployment insurance-related benefits that the applicant should transfer, and issue a certificate of unemployment insurance relationship transfer for the unemployed.
4. The transfer agency shall, within 7 working days from the date of receiving the Certificate of Transfer of Unemployment Insurance Relationship of Unemployed Persons and the amount of relocation subsidy, verify the relevant benefits of unemployment insurance and notify the applicant of the acceptance result. The time limit for receiving unemployment insurance benefits shall be calculated from the date when the agency approves the unemployment insurance benefits.
