Spain defines a trademark as a mark capable of distinguishing the goods or services of one person from the same or similar goods or services of another person. Spanish Trademark Law stipulates that the right to register a trademark is granted to the first applicant. Natural persons with Spanish nationality and Spanish legal persons have the right to apply for trademark registration. In addition, foreigners or foreign enterprises with a fixed residence or a real and effective industrial and commercial establishment in Spanish territory, or citizens of any member state of the Paris Convention and the World Trade Organization, are entitled to apply for trademark registration.
