Will domain name registration cause trademark infringement?

Yes, if the trademark has been registered and the domain name is re-registered with the trademark, it will be an infringement. The law stipulates that infringement includes: (1) Using the same product or similar products without the permission of the trademark registrant. Using a trademark that is the same as or similar to its registered trademark on the goods; (2) selling goods that infringe the exclusive rights of a registered trademark; (3) forging or making without authorization the registered trademark signs of others or selling counterfeit or making without authorization registered trademark signs; ( 4) Changing the registered trademark without the consent of the trademark registrant and putting the goods with the changed trademark back into the market; (5) Causing other damage to the exclusive right to use the registered trademark of others.

Article 57 of the Trademark Law of the People's Republic of China

Anyone who commits any of the following acts shall be deemed to have infringed upon the registration. The right to exclusive use of a trademark: (1) Using a trademark that is identical or similar to the registered trademark on the same or similar goods without the permission of the trademark registrant (2) Selling goods that infringe the exclusive right to use a registered trademark (3) Counterfeiting, Producing other people’s registered trademarks without authorization or selling counterfeit or unauthorized registered trademarks (4) Changing the registered trademark without the consent of the trademark registrant and putting the goods with the replaced trademark back into the market (5) Giving registered trademarks to others Any other damage caused by the exclusive right.
