Return of unjust enrichment occurs between the beneficiary and the injured person creditor-debt relationship. Therefore, the victim can file a civil lawsuit with the people and ask the beneficiary of unjust enrichment to return the benefits obtained.

Unjust enrichment refers to benefits that have no legal basis, or that have subsequently lost their legal basis and are recognized as benefits gained from causing losses to others, and are subject to the obligation to return them. Such as overcharging for goods when selling goods, taking the lost property as one's own, etc. The person who obtains the benefit is called the beneficiary, and the person who suffers the damage is called the victim.

The acquisition of unjust enrichment is not due to the illegal behavior of the beneficiary against the victim; it is caused by the negligence, misunderstanding or fault of the victim or a third party. A debt relationship is thus formed between the beneficiary and the victim, with the beneficiary being the debtor and the victim being the creditor.

"Measures for the Payment of Litigation Fees"

Article 13 Case acceptance fees shall be paid according to the following standards:

(1) For property cases, based on the amount or value of the litigation claim, the cumulative payment shall be made in installments according to the following proportions:

1. If it does not exceed 10,000 yuan, 50 yuan shall be paid for each case;

2. The portion exceeding RMB 10,000 to RMB 100,000 shall be paid at 2.5%;

If it is calculated as RMB 200 million, you should pay RMB 300 in advance for the first-instance case acceptance fee. If one party is dissatisfied with the first-instance judgment and initiates the second-instance procedure, the first-instance acceptance fee shall be paid in advance.

(2) Non-property cases

1. For divorce cases, 10-50 yuan is required for each case. If property division is involved, the total property does not exceed 10,000 yuan, and there is no additional fee; If the amount exceeds 10,000 yuan, 1% will be charged for the excess amount.

2. For cases of infringement of name rights, title rights, portrait rights, reputation rights, and honor rights, a fee of 50 yuan to 100 yuan will be paid for each case.

3. For cases of infringement of patent rights, copyrights, and trademark rights, a fee of 50 yuan to 100 yuan shall be paid for each case; the amount in dispute shall be paid according to the charging standards for property cases.

4. For labor dispute cases, the fee is 30 yuan to 50 yuan per case. 5. For other non-property cases, the fee is 10 to 50 yuan per case.
