What are the conditions for trademark transfer?

With the continuous development of the economy, competition among industries has become increasingly fierce. In order to ensure that the company has a place in the market, they will promote their brand accordingly. Therefore, the company's registered trademark has become the focus of people's attention. In order to prevent similar infringement of the trademark, the company will also register the corresponding trademark as a defensive trademark, which has led to this. The number of trademark registrations is increasing. But we know that the trademark registration cycle is not suitable for enterprise development. Many people will choose to transfer to obtain the corresponding trademark. So under what circumstances can trademark transfer be carried out? What are the conditions required for a successful trademark transfer?

Conditions for trademark transfer:

1. The transferee must be qualified as a trademark registration applicant; for example, an individual purchasing a trademark requires a personal business license; an enterprise purchasing a trademark requires Enterprise business license.

2. To transfer registered trademarks for medicines and tobacco products, a certificate from the competent department of commodity production must be submitted. This is clearly stipulated in the Trademark Law.

3. The transferee must ensure the quality of the goods using the registered trademark.

4. The transferor transfers the same or similar trademarks registered on the same or similar goods together; the transfer is registered in accordance with Article 25 of the "Regulations on the Implementation of the Trademark Law of the People's Republic of China" If the trademark is a trademark, the trademark registrant shall transfer the same or similar trademark registered on the same or similar goods together; if the trademark is not transferred, the Trademark Office shall notify the transferor to make corrections within a time limit. If no correction is made upon expiration of the time limit, the application for transfer of the registered trademark will be deemed to have been abandoned, and the Trademark Office shall notify the applicant in writing.

5. If the trademark owner licenses the goods to others for use, he must obtain the consent of the licensee before transferring, handle the aftermath in accordance with the provisions of the licensing contract, and shall not harm the interests of the licensee due to the transfer.

These are the conditions we need to meet during the trademark transfer process. Since the trademark transfer period is relatively short, it is recommended that friends who urgently need a trademark can choose to transfer to obtain the corresponding trademark. However, during the trademark transfer process, corresponding materials still need to be prepared for a smooth transfer.
