Where an export product infringes the trademark right, it may be punished according to the provisions of the Trademark Law, and the infringed may complain to the administrative department for industry and commerce and the trademark administration department. If there are counterfeit trademarks, and the circumstances are serious, it may constitute a crime. The infringed person can report the case to the public security organ, so that the public security organ can file a case for investigation. Infringement of trademark rights shall bear civil liability for compensation, and the amount of compensation shall be determined according to the actual losses caused or the interests obtained by the infringer.
Legal basis: Article 65 of the Patent Law of People's Republic of China (PRC), if a patent is exploited without the permission of the patentee, that is, the patent right is infringed and a dispute arises, it shall be settled by the parties through consultation; Unwilling to negotiate or failing to do so, the patentee or interested party may bring a suit in a people's court or request the administrative department for patent affairs to handle it. When the administrative department for patent affairs finds that the infringement is established, it may order the infringer to stop the infringement immediately. At the request of the parties concerned, the administrative department for patent affairs may mediate the amount of compensation for patent infringement; If mediation fails, the parties may bring a lawsuit to the people's court in accordance with the Civil Procedure Law of People's Republic of China (PRC).
Article 91 of the Customs Law of People's Republic of China (PRC), in violation of the provisions of this law, imports or exports goods that infringe the intellectual property rights protected by laws and administrative regulations of People's Republic of China (PRC), and the infringing goods shall be confiscated by the customs according to law and fined; If a crime is constituted, criminal responsibility shall be investigated according to law.
