Article 1 In order to strengthen the supervision and management of production safety in construction projects and ensure the safety of people's lives and property, in accordance with the "Construction Law of the People's Republic of China" and the "Production Safety Law of the People's Republic of China" These measures are formulated in light of the actual conditions of this province and other relevant laws and regulations. Article 2 Those engaged in relevant activities such as new construction, expansion, reconstruction and dismantling of construction projects within the administrative region of this province, as well as the implementation of supervision and management of construction project safety production, must comply with the State Council's Regulations on the Administration of Construction Project Safety Production and these Measures.
The term "construction projects" as mentioned in these Measures refers to civil engineering, construction projects, line pipelines and equipment installation projects, and decoration projects. Article 3 The provincial construction administrative department is responsible for the supervision and management of production safety in construction projects within the administrative region of the province, and organizes the implementation of these Measures.
The municipal (prefecture) and county (city, district) construction administrative departments are responsible for the supervision and management of production safety in construction projects within their respective administrative regions.
The construction project safety supervision and management agencies affiliated to the construction administrative departments at or above the county level are specifically responsible for the supervision and management of construction project safety production, and implement administrative penalties according to the entrustment of the construction administrative departments.
Relevant departments such as transportation, water conservancy, communications, civil aviation, health and family planning, civil air defense, and religion shall be responsible for the supervision and management of production safety in relevant professional construction projects in accordance with the division of responsibilities. Article 4 The production safety supervision and management department at or above the county level shall strengthen the comprehensive supervision of production safety work in construction projects within its own administrative region; the supervision and management of production safety by the construction administrative department shall accept the guidance and coordination of the production safety supervision and management department at the same level and supervision. Article 5: The production safety management of construction projects implements a production safety license system.
The construction unit shall, in accordance with the basic construction procedures, outcontract construction projects such as new construction, expansion, reconstruction and demolition to construction units with corresponding qualification levels.
The construction unit shall provide the construction unit with a safety protection design plan for the protection of adjacent buildings and deep foundation pit support. The construction unit shall formulate construction safety technical measures in accordance with the design plan and organize their implementation. Article 6 When applying for a construction license or start-up report, the construction unit shall go through safety supervision procedures and provide the following information on safety construction measures for the construction project:
(1) Project winning notice;
(2) General layout of the construction site;
(3) Planning and construction of temporary facilities;
(4) Determination and planning of production safety costs;
(5) Special safety construction organization design or measures for temporary use of electricity, earthwork, formwork, scaffolding, hoisting and protection of adjacent buildings;
(6) Construction The status of unit project leaders, safety management personnel, and special operations personnel holding certificates for work;
(7) Roster of relevant safety management personnel of construction units and supervision units;
(8) Payment of accidents Injury insurance certificate;
(9) Special deposit certificate for production safety expenses;
(10) Relevant information stipulated in relevant laws, regulations and rules. Article 7 When preparing project budget estimates, construction units shall determine the costs required for a safe working environment and safe construction measures in accordance with relevant national and provincial regulations.
After the production safety expenses are determined and before going through the safety supervision procedures, the construction unit shall allocate the production safety expenses in one go to the special fund account for production safety expenses of the construction unit that wins the bid.
During the construction process, the construction unit shall comply with the relevant provincial safety production expense management regulations and accept on-site safety inspection evaluation by the construction administrative department.
Construction units should use dedicated funds for production safety expenses. The construction administrative department shall supervise and inspect the use of safety production expenses by construction units. Article 8 Production safety expenses shall not be included in bidding items.
The bidding supervision department shall incorporate the provisions of the preceding paragraph into the review content.
Article 9 The safety production supervision responsibilities of the supervision unit are:
(1) Supervise and inspect the safety technical measures in the construction organization design or the implementation of safety measures in the special construction plan;
( 2) Supervise and inspect the implementation of the safety production responsibility system of the construction unit;
(3) Supervise and inspect the implementation of safety education and the use of safety protection equipment by the construction unit;
(4) Supervision Check the acceptance procedures of construction machinery, equipment and safety facilities of the construction unit, and sign opinions;
(5) Supervise and inspect whether the safety production expenses of the construction unit are used to purchase and update qualified construction safety protection equipment and facilities, and implement Safe construction measures to improve safe production conditions;
(6) Establish and improve relevant safety supervision archives in accordance with relevant professional management regulations. Article 10 Supervision units shall adopt various forms to conduct safety supervision and inspections and establish supervision and inspection records.
The chief supervisory engineer shall be responsible for the overall safety supervision of construction projects. Article 11 The project leader of the construction unit is responsible for the safe construction of the construction project. One project leader shall not be responsible for the construction management of two or more projects at the same time.
