2. The signature, original text or words of the applicant for registration or his business predecessor;

I. Summary

Trademark registration adopts the principle of prior use, and protects commodity trademarks, certification trademarks, series trademarks, joint trademarks, defensive trade mark and color trademarks.

The new Trademark Law, which came into effect on June 1 2000, strengthened the protection of service trademarks, and the validity period of registration was revised from 14 to 10.

Brunei Trademark Law 1984 and its implementing rules 1957 are similar to those of Britain 1938. Commodity classification is the same as international commodity classification. Only specific commodities or commodity categories can be registered, and each commodity category should be applied separately. Brunei is a member of the World Intellectual Property Organization.

Second, the elements of a registrable trademark

The trademark register is divided into book A and book B, similar to 1938 of the British Trademark Law. The trademark registration in Book A must contain at least one element or consist of one of the following elements:

1. Name of company, individual or enterprise in original or unique form;

2. Signature of the applicant for registration or his business predecessor;

3. Original words or phrases;

4. Words or phrases that do not directly describe the characteristics and quality of goods do not belong to place names and surnames in the usual sense;

5. Any other distinctive trademark. However, names, signatures, words or phrases other than those mentioned in 1-4 above cannot be registered unless the registrar or the court considers them to be prominent trademarks. Trademarks registered in Singapore and Britain are considered to be prominent trademarks. The registrar has the right to decide whether a trademark is distinctive or not. If the trademark design includes a person's name or portrait, the registration office may require the individual's consent. If the person concerned has died, the personal representative must issue a consent form;

6. Trademarks used for textile crystals, yarns and threads (all goods in categories 23 and 24 except sarong and sarongbu) shall not be registered in Brunei unless they have been approved for registration in Britain.

Three, the constituent elements of unregistered trademarks

The Registrar refuses to accept the following applications:

2. A portrait of His Highness the Sultan or a member of the Royal Brunei, or a portrait of His Majesty the King or a member of the Royal Brunei, or any deceptive imitation;

3. The "Red Cross" or "Geneva Cross" on the red background of the Swiss Confederation, the Geneva symbol and other Red Cross or White Cross; Or silver cross on red background or similar color or multicolor design;

4. It may make people think that the applicant has a royal status or is supported by the royal or imperial coat of arms, decorative patterns and replicas of the coat of arms, which are very similar to badges or coat of arms, leading to misunderstanding, or the royal or imperial crown, or the national flag or "royal", "emperor" or any other words, letters or graphics.
