A trademark (1) with ethnic discrimination shall be judged as having ethnic discrimination if it is identical with or similar to the name of a certain ethnic group and vilifies or belittles a certain ethnic group. (2) Where a trademark is racially discriminatory, if it is judged to have adverse effects, it shall be rejected in accordance with Item (8) of Paragraph 1 of Article 10 of the Trademark Law.
