Article 6 An application for recognition of a famous trademark shall meet the following conditions: (1) The applicant is the owner of the registered trademark and his domicile is within the administrative region of this province; (2) The trademark shall be registered from the date of approval It has been used continuously for 3 years without ownership disputes; (3) The goods using the trademark have excellent quality among similar goods, remain stable for a long time, and have good after-sales service, and the trademark has a high reputation among the relevant public and good reputation; (4) The output, sales, tax, market share and other major economic indicators of the goods using the trademark in the past three years are among the best in the same industry in the province, and have a relatively wide sales area; ( 5) The applicant has not infringed on the exclusive rights of others to register trademarks or other serious illegal business activities in the past three years; (6) The applicant has strict trademark use, management and protection measures in production and business activities.
Article 7 To apply for the recognition of a famous trademark, the applicant shall submit the following materials to the industrial and commercial administration department of the local provincial and municipal government for preliminary review: (1) Application for recognition of a famous trademark; (2) Certificate of qualifications of the applicant and Copies thereof; (3) Copies of the trademark registration certificate and certificates of change, renewal, and transfer; (4) Written materials on the trademark use management and protection system; (5) Sales volume and sales area of ??goods using the trademark; (4) 6) The sales volume, tax amount, market share and other major economic indicators of the goods using the trademark in the past three years and their ranking in the same industry in the province or other materials that can prove that the trademark is famous; (7) Use of the trademark advertising materials for the products in the past three years.
Article 8 The provincial and municipal industrial and commercial administrative departments shall conduct a preliminary review in accordance with the conditions for famous trademarks within 30 days from the date of acceptance of the application, and sign the preliminary review opinions. Those that meet the conditions for recognition of famous trademarks shall be submitted to the provincial industrial and commercial administration department together with the application materials; those that do not meet the conditions for recognition of famous trademarks shall return the application materials and inform the applicant in writing of the reasons for rejection.
Article 9 The provincial administrative department for industry and commerce shall hire experts in economics, law, science and technology or related industries to be specifically responsible for the evaluation of famous trademarks. Relevant experts should review whether the applicant's registered trademark qualifies as a famous trademark based on the famous trademark application materials and the specific standards for famous trademark recognition conditions.
The number of experts attending the review should be no less than 9. If more than 2/3 of the experts agree, the review will be passed.
Article 10: For famous trademarks that have passed the review, the provincial industrial and commercial administration department will issue recognition documents, announce them, and issue the "Henan Province Famous Trademark Certificate" to the applicant; if they fail to pass the review, they shall be Notify the applicant in writing and state the reasons.
Article 11 The validity period of a famous trademark is 3 years, starting from the date of announcement. Within 3 months before the expiration of the famous trademark, if the famous trademark owner believes that it is necessary to maintain its famous trademark qualification, he may submit application materials to the provincial industrial and commercial administration department to apply for renewal according to the application recognition procedures. For those who meet the conditions for famous trademarks, the provincial industrial and commercial administration department shall approve the extension and make an announcement. The validity period of each extension is 3 years; for those who do not meet the conditions for famous trademarks, the extension will not be granted and the applicant shall be notified in writing and explain the reasons. If no renewal application is filed after expiration, the trademark qualification will be deemed to have been automatically abandoned.
Article 12 No fees shall be charged to applicants for the examination and recognition of famous trademarks.
