What is the process of domestic patent transfer?

Patent transfer in my country usually takes the following three forms:

1. Overall patent transfer, implementation of exclusive license, so-called transfer of patent ownership, 10 years of independent property rights. If the patentee (inventor) transfers the entire patent to a company, after both parties sign the transfer contract, the inventor (patentee) only retains the invention rights.

2. Exclusive license for patent implementation means that a company buys out the patent. Only the patentee and the family business can use the technology, and the patent cannot be transferred to a third party again.

3. A general license for patent implementation means that the patentee authorizes a certain enterprise or individual to produce the patent. It can also authorize multiple enterprises or individuals.

2. What information should be filled in for patent transfer

1. It is necessary to fill in the "Declaration Form for Change of Bibliographic Items" (which can be downloaded from the Patent Office website) and specify the patent number (or application number) , the patentee (or applicant), the name of the invention, and the information of the assignor and assignee.

2. Submit supporting documents: If the patentee files a change request due to the transfer or donation of rights, he or she shall submit a transfer or donation contract. The contract is concluded by the unit and must be affixed with the unit's official seal or a contract-specific seal. When citizens conclude a contract, they must sign or seal it. If there are multiple patentees, proof of consent of all patentees to the transfer or donation should be submitted

3. Mail the above two documents, or submit them in person to the Patent Office, or the local agent of the Patent Office Department

4. Pay the bibliographic item change fee of RMB 200 within one month from the date of request. The transfer procedures are relatively simple. You can handle it yourself directly or entrust an agency. The Patent Office will generally issue a formality compliance notice within 2 to 6 months (informing the patentee or applicant of the change from assignor to assignee). Both parties can also check the change results through the Patent Office website, indicating that the transfer is successful. If both parties want to prove it through documentation, they can request the Patent Office to obtain a copy of the patent register, which will detail the legal status of the patent.

The transfer of patent rights means that the ownership or holding rights of the patent have been transferred. The assignee of the patent right becomes the patentee and enjoys the ownership or holding rights of the patent, and the transferor is the original patent right. The person no longer enjoys the ownership or right to hold the patent; the license to implement the patent means that the ownership or right to hold the patent has not been transferred. The patent right is still retained by the patentee, and the licensee only obtains the right to implement the patent. right.
