The elements that can be registered as trademarks in Turkey include text, name, graphics, three-dimensional logo, color combination, slogan, sound, smell, appearance, dynamic graphics, etc. Among them, three-dimensional logos, color combinations, and sounds need to meet specific requirements when applying for registration.
The classification of goods or services for trademarks in Turkey adopts the International Classification of Goods and Services for Trademark Registration. The principle of applying for trademark registration is based on one application per category. According to the provisions of the Trademark Law, Turkey can accept registration applications for commodity trademarks, service marks, joint trademarks, series trademarks, color trademarks and collective trademarks.
The acquisition of Turkish trademark rights is based on the principle of combining registration and use. Trademark rights are granted to the person who first files an application for trademark registration, but within 3 years after the trademark is registered, the first user of the trademark can use the trademark within 6 months from the date of subsequent trademark registration or from the date the trademark registrant starts to use the trademark. Within 6 months, based on the fact that the trademark has a certain degree of popularity in the market, prevent the subsequent trademark registrant from using the trademark through litigation or rights request procedures and file a request for cancellation of the trademark registration. The time limit for claiming this right shall not exceed 3 years after the trademark registration announcement.
Turkey is a party to international intellectual property treaties such as the TRIPs Agreement, the Trademark Law Treaty, the Paris Convention, the Nice Agreement, the W1P0 Convention, the Singapore Treaty and the Vienna Agreement. Contracting country; Turkey has joined the "Madrid Protocol", so trademark registration can also be handled through the "Madrid International Registration".
