The trademark applied for registration should meet the following conditions:
1. The trademark applied for registration must have legal components, that is, it must be text, graphics or a combination thereof, otherwise it cannot be used as a trademark use.
2. The words, graphics or combinations used in the trademark should have distinctive features and be easy to identify.
3. The trademark applied for registration shall not use words or graphics prohibited by law.
4. The trademark applied for registration shall not be identical or similar to a registered trademark that has been revoked or canceled for less than one year.
5. The trademark applied for registration shall not be identical or similar to a trademark that has been registered or preliminarily approved by others for the same or similar goods or services.
Legal basis:
Article 43 of the Trademark Law of the People's Republic of China: A trademark registrant may license others to use its registered trademark by signing a trademark license contract . The licensor shall supervise the quality of the goods used by the licensee using its registered trademark. The licensee shall ensure the quality of the goods using the registered trademark.
If you use someone else's registered trademark with permission, you must indicate the name of the licensee and the place of origin of the goods on the goods using the registered trademark.
When permitting others to use its registered trademark, the licensor shall submit its trademark use license to the Trademark Office for record, and the Trademark Office shall announce it. The trademark use license shall not be used against bona fide third parties without registration.
