Jiaozuo City Public Resource Trading Center’s Interim Measures for Government Procurement to Promote the Development of Small and Medium-sized Enterprises:
Article 1 is to give full play to the policy function of government procurement and promote the development of small and medium-sized enterprises in line with the national economy and society. Development policy objectives, products, services, and the development of small and medium-sized enterprises with good reputations are formulated in accordance with the "Government Procurement Law of the People's Republic of China", the "Small and Medium-sized Enterprises Promotion Law of the People's Republic of China" and other relevant laws and regulations. way.
Article 2: Small and medium-sized enterprises (including medium-sized, small and micro-sized enterprises, the same below) as mentioned in these Measures shall meet the following conditions at the same time:
(1) Meet the classification standards for small and medium-sized construction enterprises ;
(2) Provide goods manufactured by the enterprise, projects or services undertaken by the enterprise, or provide goods manufactured by other small and medium-sized enterprises. The goods referred to in this item do not include goods using registered trademarks of large enterprises.
The classification standards for small and medium-sized enterprises as mentioned in these Measures refer to the classification standards for small and medium-sized enterprises formulated by the relevant departments of the State Council based on indicators such as employees, operating income, and total assets of the enterprise.
Small and micro enterprises that provide goods manufactured by medium-sized enterprises are regarded as medium-sized enterprises.
Article 3 No unit or individual may obstruct or restrict small and medium-sized enterprises from freely entering the government procurement market in their region and industry. Government procurement activities shall not be based on registered capital, total assets, operating income, employees, Small and medium-sized enterprises are treated differently or discriminatorily based on supplier size conditions such as profits and tax payments.
Article 4 Each department responsible for preparing departmental budgets (hereinafter referred to as each department) shall strengthen the preparation of government procurement plans, formulate specific plans for procurement from small and medium-sized enterprises, and make overall plans for the department (including Affiliated units, the same below) procurement projects for small and medium-sized enterprises. On the premise of meeting the basic needs of the agency's own operation and provision of public services, more than 30% of the department's total annual government procurement project budget should be reserved specifically for procurement by small and medium-sized enterprises, of which the proportion reserved for small and micro enterprises Not less than 60.
When organizing procurement activities, the purchaser or procurement agency shall indicate in the bidding documents, negotiation documents, and inquiry documents that the project is specifically for procurement by small and medium-sized enterprises or small and micro enterprises.
Article 5 For projects that are not specifically targeted at small and medium-sized enterprises, the purchaser or procurement agency shall stipulate in the bidding documents, negotiation documents, and inquiry documents that the price of small and micro-enterprise products shall be 6%. -10 deduction, use the deducted price to participate in the review. The specific deduction ratio is determined by the purchaser or procurement agency.
Small and medium-sized enterprises participating in government procurement activities should provide the "Small and Medium-sized Enterprise Declaration Letter" (see attachment) stipulated in these Measures.
Article 6 encourages large and medium-sized enterprises and other natural persons, legal persons or other organizations to form consortiums with small and micro enterprises to jointly participate in government procurement activities that are not specifically targeted at small and medium-sized enterprises. It is stipulated in the joint agreement that if the contract value of small and micro enterprises accounts for more than 30% of the total contract value of the consortium, the consortium may be given a price deduction of 2-3%.
If all parties to the consortium are small or micro enterprises, the consortium will be regarded as a small or micro enterprise and enjoy the support policies stipulated in Articles 4 and 5 of these Measures.
There shall be no investment relationship between large and medium-sized enterprises and other natural persons, legal persons or other organizations that form a consortium and small and micro enterprises.
Article 7: After small and medium-sized enterprises obtain government procurement contracts in accordance with the policies stipulated in Articles 4, 5, and 6 of these Measures, small and micro enterprises shall not subcontract or subcontract to large or medium-sized enterprises. , medium-sized enterprises are not allowed to subcontract or subcontract to large enterprises. Article 8 encourages purchasers to allow large enterprises that have obtained government procurement contracts to subcontract to small and medium-sized enterprises in accordance with the law.
The amount of subcontracting by large enterprises to small and medium-sized enterprises shall be included in the statistical amount of procurement for small and medium-sized enterprises.
Article 9 encourages purchasers to provide appropriate support to small and medium-sized enterprises in terms of performance bonds, payment terms, payment methods, etc. when signing government procurement contracts with small and medium-sized enterprises. The purchaser shall pay the purchase funds in full and on time as stipulated in the contract.
Article 10 encourages the introduction of credit guarantee means in government procurement activities to provide professional guarantee services for small and medium-sized enterprises in financing, bidding guarantees, performance guarantees, etc.
Article 11 Financial departments and relevant departments at all levels should increase training, guidance and professional consulting services for small and medium-sized enterprises to participate in government procurement, and improve the ability of small and medium-sized enterprises to participate in government procurement activities.
Article 12 Each department shall report to the financial department at the same level in the first quarter of each year the specific situation of its department’s procurement for small and medium-sized enterprises in the previous year, and publicly reserve the information in the government procurement release media designated by the Ministry of Finance Project implementation status and the procurement status of other projects of this department for small and medium-sized enterprises.
Article 13 Financial departments at all levels should actively promote the informatization of government procurement, improve the transparency of government procurement information release, and provide stable channels for small and medium-sized enterprises to obtain government procurement information.
Article 14: Financial departments at all levels, together with the competent departments of small and medium-sized enterprises, shall establish and improve relevant systems for government procurement to promote the development of small and medium-sized enterprises, and strengthen supervision and inspection of the implementation of relevant policies.
Each department is responsible for the execution and management of its own government procurement work to promote the development of small and medium-sized enterprises.
Article 15 The identification of small and medium-sized enterprises in government procurement supervision and inspection and complaint handling shall be the responsibility of the small and medium-sized enterprise administrative department at or above the county level where the enterprise is located.
Article 16 If a purchaser, procurement agency or small and medium-sized enterprise commits any violation of laws and regulations during government procurement activities, it shall be dealt with in accordance with the Government Procurement Law and relevant laws and regulations.
Article 17 The Ministry of Finance and the Ministry of Industry and Information Technology are responsible for the interpretation of these Measures.
Article 18 These Measures shall come into effect on January 1, 2012.
