The purpose of this regulation is to show respect for foreign governments and armies; However, all the above items are not prohibited, but can be used with the consent of foreign governments in accordance with relevant international agreements. This content was added in the second revision of the Trademark Law.
(3) identical with or similar to the name, flag and emblem of an intergovernmental international organization, except with the consent of the organization or not easily misleading the public. The purpose of this provision is to safeguard the dignity of these organizations and show respect for them. For the above items, the original provisions are not allowed to be used, but now the exception provisions have been added in accordance with relevant international agreements.
(4) It is the same as or similar to the official mark or inspection mark indicating actual control and guarantee, unless it is authorized. This regulation embodies the protection of some specific marks and defines the specific conditions for use. This regulation is added according to the actual situation.
(5) The names and symbols of the Red Cross and Red Crescent are the same or similar. This provision shows respect for these international groups.
(6) ethnic discrimination. This provision embodies the principle that all ethnic groups are equal and discrimination and oppression against any ethnic group are prohibited as stipulated in our Constitution.
(7) exaggerated propaganda and deceptive. This provision embodies the principle of honesty and credibility in the use of trademark marks, and shall not deviate from the authenticity and deceive the public.
(8) It is harmful to socialist morality or has other adverse effects. This regulation embodies the requirements of following socialist morality, strengthening the construction of socialist spiritual civilization, insisting on advocating fine social customs, safeguarding the interests of the public and respecting social morality.
