Where an invention-creation completed by making use of the material and technical conditions of the entity has a contract with the inventor or designer to stipulate the right to apply for a patent and the ownership of the patent, such agreement shall prevail.

Factors affecting the definition of service invention creation;

First of all, the inventor or designer of an invention-creation should be the employee of the entity applying for a patent.

The implementation of the tasks of this unit includes the following situations:

1) Inventions and creations completed by inventors or designers in their own work. For example, a designer who is engaged in pattern design in a printing and dyeing factory, his new pattern is job design.

2) Although it has nothing to do with the inventor's or designer's own job, it belongs to the invention-creation completed when performing the special task assigned by the unit. For example, the inventor's job is to design machine tools, and the unit temporarily sends him to design new drawing tables and chairs. His related inventions are also job inventions.

(3) Inventions and creations made by employees within one year after their resignation, retirement or job transfer related to their own jobs or tasks assigned by their original units.
