Chapter 1 General Provisions Article 1 In order to strengthen the management of the use of green food labels, ensure the credibility of green food, promote the healthy development of the green food industry, and safeguard the legitimate rights and interests of producers, operators and consumers, according to the "People's Government of the People's Republic of China" The Agricultural Law of the People's Republic of China, the Food Safety Law of the People's Republic of China, the Agricultural Products Quality and Safety Law of the People's Republic of China, and the Trademark Law of the People's Republic of China formulate these Measures. Article 2 The term “green food” as mentioned in these Measures refers to safe, high-quality edible agricultural products and related products produced in a good ecological environment, produced in accordance with green food standards, subject to full-process quality control, and obtained the right to use the green food label. Article 3 Green food marks are registered as certification trademarks in accordance with the law and are protected by law. Article 4 The agricultural and rural authorities of the people's governments at or above the county level shall supervise and manage green food and green food labels in accordance with the law. Article 5 The China Green Food Development Center is responsible for the review, certification and post-certification follow-up inspection of applications for the use of national green food labels.

The green food working agency affiliated to the agricultural administrative and rural department of the provincial people's government (hereinafter referred to as the provincial working agency) is responsible for the acceptance, preliminary review and post-certification follow-up inspection of applications for the use of green food labels in this administrative region. Article 6 Standards and specifications for green food production environment, production technology, product quality, packaging, storage and transportation shall be formulated and promulgated by the Ministry of Agriculture and Rural Affairs. Article 7 The technical institution responsible for environmental testing of green food products and origins shall have corresponding testing conditions and capabilities, and shall be qualified in accordance with the law. The China Green Food Development Center shall select and appoint the best in accordance with the principles of fairness, justice and competition and report to the Ministry of Agriculture. Article 8 The agricultural and rural administrative departments of local people's governments at or above the county level shall encourage and support green food production, incorporate it into local agricultural and rural economic development plans, and support the construction of green food production bases. Chapter 2 Application and Approval of Mark Use Article 9 Products applying for the use of green food marks shall comply with laws and regulations such as the Food Safety Law of the People's Republic of China and the Agricultural Products Quality Safety Law of the People's Republic of China. It is stipulated that it is within the scope approved by the Trademark Office of the State Intellectual Property Office and meets the following conditions:

(1) The environment of the place where the product or product raw materials are produced meets the environmental quality standards of the place where green food is produced;

(2) The use of pesticides, fertilizers, feeds, veterinary drugs and other inputs conforms to the guidelines for the use of green food inputs;

(3) Product quality conforms to the green food product quality standards;

(4) ) Packaging, storage and transportation comply with green food packaging, storage and transportation standards. Article 10 A production unit that applies to use the green food label (hereinafter referred to as the applicant) shall meet the following conditions:

(1) Be able to independently bear civil liability;

(2) Have Environmental conditions and production technology for green food production;

(3) Having a complete quality management and quality assurance system;

(4) Having production technicians suitable for the production scale and quality control personnel;

(5) Have a stable production base;

(6) Have no quality safety accidents or bad integrity records within the three years before application. Article 11 The applicant shall apply to the provincial working agency and submit the following materials:

(1) Application form for use of logo;

(2) Product production technical regulations and Quality control specifications;

(3) Pre-packaged product packaging labels or design samples;

(4) Other certification materials submitted as required by the China Green Food Development Center. Article 12 Provincial working agencies shall complete the material review within ten working days from the date of receipt of the application. If the requirements are met, the application will be accepted, and qualified inspectors will be organized to complete on-site inspections during the production period of the product and product raw materials; if the requirements are not met, the application will not be accepted, and the applicant will be notified in writing and the reasons will be given.

If the on-site inspection is qualified, the provincial working agency shall notify the applicant in writing, and the applicant shall entrust a testing agency that meets the provisions of Article 7 to test the applied product and the corresponding environment of origin; if the on-site inspection fails , the provincial work agency shall return the application and inform the reasons in writing. Article 13 After accepting the entrustment of the applicant, the testing agency shall arrange on-site sampling in a timely manner, complete the testing work within twenty working days from the date of sampling of product samples, and within thirty working days from the date of sampling of environmental samples, and issue a The product quality inspection report and the environmental monitoring report of the place of production shall be submitted to the provincial working agency and the applicant.

The testing agency shall be responsible for the testing results. Article 14 Provincial-level working agencies shall submit preliminary review opinions within 20 working days from the date of receipt of the product inspection report and the environmental monitoring report of the place of origin. Those who pass the preliminary review will submit the preliminary review opinions and relevant materials to the China Green Food Development Center. If the applicant fails the initial review, the application will be returned and the reasons will be notified in writing.

Provincial working agencies should be responsible for the results of the preliminary review. Article 15 The China Green Food Development Center shall complete the written review within thirty working days from the date of receipt of the application materials submitted by the provincial work agency, and organize expert review within twenty working days. When necessary, on-site inspections should be conducted. Article 16 The China Green Food Development Center shall make a decision on whether to issue a certificate within five working days based on the opinions of expert reviewers. If it agrees to issue the certificate, it will sign a green food mark use contract with the applicant, issue a green food mark use certificate, and make an announcement; if it disagrees with the issuance of the certificate, it will notify the applicant in writing and provide the reasons.
