Trademark priority

The so-called priority refers to the priority that a trademark registration applicant enjoys for its trademark registration on the application date. Article 24, Paragraph 1 of the Trademark Law stipulates that a trademark registration applicant shall file another registration application for the same trademark in China for the same goods within 6 months from the date when the trademark is first filed for trademark registration in a foreign country. Priority may be enjoyed in accordance with an agreement signed between a foreign country and China or an international treaty to which China is a party, or in accordance with the principle of mutual recognition of priority.
