How to apply for review after a trademark has been revoked

Methods for revocation of trademark review: Under normal circumstances, if the party concerned is dissatisfied, he or she may apply to the Trademark Review and Adjudication Board for review within fifteen days from the date of receipt of the notice. Within nine months from the date of receipt of the application, the Trademark Review and Adjudication Board shall make a decision and notify the parties in writing. If the legal period expires and the parties concerned do not raise any objection, the decision to cancel the registered trademark or the review decision shall take effect.

Legal Basis

Article 54 of the Trademark Law of the People's Republic of China

If the Trademark Office cancels or refuses to cancel a registered trademark If the party concerned is dissatisfied with the decision, it may apply to the Trademark Review and Adjudication Board for review within fifteen days from the date of receipt of the notice. The Trademark Review and Adjudication Board shall make a decision within nine months from the date of receipt of the application and notify the parties in writing. If there are special circumstances that require an extension, it can be extended for three months with the approval of the industrial and commercial administration department of the State Council. If the party concerned is dissatisfied with the decision of the Trademark Review and Adjudication Board, it may file a lawsuit with the People's Court within thirty days from the date of receipt of the notice.

Article 55

Upon expiration of the legal period, the party concerned does not apply for review of the decision of the Trademark Office to cancel the registered trademark or fails to submit a review decision to the Trademark Review and Adjudication Board. If the People's Court files a lawsuit, the decision to cancel the registered trademark and the review decision shall take effect.

The revoked registered trademark shall be announced by the Trademark Office, and the exclusive right to use the registered trademark shall be terminated from the date of announcement.
