Applicants can entrust an organization with trademark agency qualifications recognized by the State Administration for Industry and Commerce to act as an agent, or they can go to the Trademark Registration Hall of the State Trademark Office to apply directly. Applicants should decide whether to entrust an organization with trademark agency qualifications to handle the registration of a trademark on their behalf or go directly to the Trademark Office to handle it based on their own specific circumstances.

(2) Inquiry on prior registration rights of trademarks

Trademark inquiry refers to whether the trademark registration applicant or his agent, before filing an application for registration, checks whether the trademark applied for is consistent with the trademark registration application. Search whether there are identical or similar trademarks with prior rights. It is worth noting that although trademark search is not a required procedure for registering a trademark (following the principle of voluntary search), this work can greatly reduce the risks of trademark registration and improve the certainty of trademark registration.

(3) Documents and fill-in of trademark registration application

To apply for trademark registration, you must use the unified application form developed and published by the State Administration for Industry and Commerce. The application form can be obtained from the Registration Hall of the Trademark Office. If a trademark agency is entrusted to handle the matter, it will be provided by the agency.

To apply for trademark registration, the following documents must be submitted to the Trademark Office:

1. An "Application for Trademark Registration", which should be stamped with the applicant's seal. If the applicant is a natural person, he shall sign the application form. The application and other relevant documents should be typed or printed.

2. A copy of a valid certificate that can prove the applicant’s identity (qualification), and the original must be presented at the same time.

3. Five copies of the trademark drawings should be submitted for each trademark registration application

(4) Applications for several special types of trademarks

Applying for general trademark registration on general goods or services, submitting the above documents and filling in the application form as required is an application. The procedures are basically complete. If you apply for registration of certain special types of trademarks, there are special requirements, and the following documents must be submitted according to different circumstances.

1. When applying for registration of a collective trademark or certification mark, a statement must be made in the application form, and a certificate of subject qualifications and the management rules for the use of the trademark must be attached. The applicant for a collective trademark should be a group, association or other organization, rather than the usual applicant.

2. If you apply for trademark registration with a three-dimensional mark (three-dimensional trademark), you should declare it in the application and submit a drawing that can determine the three-dimensional shape, that is, provide an overall rendering of the mark.

3. If you apply for trademark registration with a color combination, you should declare it in the application, submit the color drawing, and give a written description of the color applied for.

4. If you apply for registration of a portrait as a trademark, you must submit a statement from the portrait owner agreeing to the applicant's application for registration of the trademark as a portrait, and it must be notarized by a notary office.

According to the provisions of the Trademark Law, the Trademark Office implements review principles for trademark applications. The Trademark Office appoints examiners to conduct the examination. The review includes two steps: formal review and substantive review.

Formal examination is an examination of whether the trademark registration application is acceptable. Formal review includes the review of the qualifications of the trademark registration applicant and whether the filled-in trademark registration application documents are true, correct, accurate, clear and complete, that is, whether the documents comply with the regulations and whether the procedures are complete.

Substantive examination is an examination of whether a trademark meets the conditions for registration. The substantive examination mainly examines from two aspects: first, to examine whether the trademark is distinctive and whether it violates legal prohibitions; second, to examine whether the trademark is identical or similar to a previously applied or registered trademark.

5. Preliminary Examination Announcement

Trademark approval refers to the decision to allow registration of a trademark registration application that complies with the relevant provisions of the Trademark Law after examination. And be announced in the "Trademark Announcement". If no one raises any objection to a preliminary approval trademark within three months from the date of publication of the preliminary approval announcement, the trademark will be registered and a registration announcement will be published at the same time.

6. Receive the Trademark Registration Certificate

After the trademark applied for registration is approved for registration, the Trademark Office will issue a "Trademark Registration Certificate" to the trademark registrant. If a trademark agency is entrusted to handle the trademark registration application, the Trademark Office will mail the Trademark Registration Certificate to the trademark agency.
